New threat puts Calif. police on heightened alert

HEMET, Calif. – The tense atmosphere surrounding a California police department plagued by booby trap attacks has been stepped up a notch following the latest threat against officers.
Someone called 911 at about 5:45 p.m. Friday saying a police car would be blown up in the Hemet-San Jacinto area in the next 24 to 48 hours, Hemet Police Chief Richard Dana said.
"We're heightening the alert," Dana told The Press-Enterprise. The caller said the attack would be in retaliation for the law enforcement sweep against the Vagos Motorcycle Club earlier this week.
The Riverside County Sheriff's Department has not been able to confirm the threat, Deputy Herlinda Valenzuela said.

At that news conference, Dana, District Attorney Rod Pacheco, state Attorney General Brown and others announced a $200,000 reward for information leading to the arrest and conviction of those responsible for the Hemet-area booby traps aimed at officers in recent weeks.
First, a natural gas pipe was shoved through a hole drilled into the roof of the gang enforcement unit's headquarters. The building filled with flammable vapor but an officer smelled the danger before anyone was hurt.
Then, a ballistic contraption was attached to a sliding security fence around the building. An officer opening the black steel gate triggered the mechanism, which sent a bullet within eight inches of his face.
In another attempted booby trap attack, some kind of explosive device was attached to a police officer's unmarked car while he went into a convenience store.
Gang enforcement officers appear to be the target of the assassination attempts, though Dana noted the devices were indiscriminate by nature and could have killed any police or law enforcement officer.
A prevalent theory for the attacks is that Vagos members were angered when members of Hemet's anti-gang task force monitored them at a funeral in a church opposite the task force's former headquarters.
The incidents have shaken a close-knit police department already demoralized by steep budget cuts that last year saw its officer numbers slashed by a quarter to 68. Officers are checking under cars for bombs and scouting for other potential hazards.
"I would call the mood tense," Capt. Marghis said. "Everyone is being very vigilant about their surroundings and the environment."

Budget Cut for Fence on U.S.-Mexico Border

Citing a plague of “cost overruns and missed deadlines,” Homeland Security Secretary Janet Napolitano said Tuesday that she would cut millions of dollars intended for a high-tech “virtual fence” along the Mexican border that has produced little more than headaches for the federal government.
Ms. Napolitano said her department would divert about $50 million in federal stimulus money intended for the project to other technological needs on the border, including laptops, radios, thermal-imaging devices and cameras requested by border guards.
In addition, she said, no money will be spent on expanding the project beyond two areas in Arizona where it is being tested until the department completes a reassessment she ordered in January.
Ms. Napolitano’s announcement came two days before a scheduled Congressional hearing on the program. The House Homeland Security Committee is expected to receive the latest in a string of Government Accountability Office reports calling the program into question. That new report says tests designed to evaluate the system are flawed and mismanaged.
Representative Bennie Thompson, Democrat of Mississippi and chairman of the committee, questioned whether it was time to pull the plug entirely.
“We still need to see whether or not this virtual fence that was promised by the department and its contractor Boeing is something that is feasible,” he said Tuesday. “Or is it just a several-hundred-million-dollar waste of taxpayer money?”
The virtual fence is part of a multiyear, multibillion-dollar effort known as the Secure Border Initiative that was announced with fanfare by the Bush administration in November 2005. Besides increasing the number of guards and expanding a border wall, it promised a sophisticated system of cameras, sensors and radar that would zero in on people crossing the border with new speed and clarity and quickly guide agents to them.
By now, according to the original timeline, the system was supposed to be working along the 2,000-mile border with Mexico. But shortly after Boeing was awarded the contract, red flags went up over its lack of oversight and potential for cost overruns.
Boeing said in a statement on Tuesday that it was “fully committed to delivering border-security technology that successfully assists” the department, but it declined to answer questions about its handling of the project. About $1.1 billion has been spent on the virtual fence, with little to show for it beyond the two testing sites in the Arizona desert and a series of embarrassments, including radar that could not function properly in the rain and wind-blown trees mistaken for border crossers.
Those first, limited segments of the fence are now expected to be delivered to the government early next year, and the Government Accountability Office has estimated that it would take several years to cover the entire border with equivalent technology.
The department has said it was revamping the system to address the problems, though the Obama administration had already scaled back financing for it, to a request of $574 million for the fiscal year that begins in October from the current $800 million Congress has authorized.
The accountability office has previously said Boeing pushed forward with designing the system without consulting with the Border Patrol, whose agents would be the primary users.
It has released 14 critical reports that, taken together, point to a system that “was over-promised and under-delivered,” said Richard Stana, director of homeland security and justice issues for the office.
The office’s latest report, to be released Thursday, says the department and Boeing have not designed tests well enough to assess the program. In some cases, the tests appeared designed to achieve positive results instead of evaluate the system.

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Illegal migrants costly to San Bernardino County
Total spent on illegal immigrants elusive

Four years ago, a group of concerned citizens expressed outrage at the cost of illegal immigration to San Bernardino County taxpayers.
The price tag for six county departments to provide services to illegal immigrants was more than $38 million a year, the county Grand Jury found.
Most of the money was spent on emergency health care and law enforcement-related services for illegal immigrants.
But that was just a fraction of the tab.
Fourteen other unnamed county departments had no idea of their costs for illegal immigrant services. If those departments had provided numbers, the bill would have been substantially higher, the Grand Jury's report stated.
The Grand Jury recommended that the county immediately require all departments to start tracking their costs.
The information should be made available to the public as well as to state and federal lawmakers who would take action to solve the immigration crisis if they knew the true cost of the problem, according to the report released in 2006.
In response, the Board of Supervisors directed all departments to track the costs, but not all of them have been complying, officials said.
County supervisors want to find out what happened.
"The public has a right to know who's receiving the services and whether or not they're entitled to them," said Supervisor Neil Derry. "These are dollars that are being used by people who don't belong here that either could be used to provide services to legal citizens or returned to them in the form of lower taxes."
Supervisor Josie Gonzales also wants to know why some departments have not followed through on the board's direction.
"The fact that we continue to incur costs for services that are extremely difficult to recover funds for is of great concern to me," Gonzales said.
Supervisor Paul Biane said he will ask Chief Administrative Officer Greg Devereaux to look into the matter. But he isn't optimistic that tracking the information will make much of a difference.
"It would be great to know," Biane said, "but at the end of the day, I don't think it will mean more revenue to the county of San Bernardino to support us for the services we provide."
Brad Kuiper, who was foreman of the Grand Jury at the time, said county officials should be complaining louder.
"It's very frustrating to me and the Grand Jury," said Kuiper, a 71-year-old Apple Valley resident. "It's all taxpayer money and we don't seem to have a vote on any of this. Until it comes from the grass roots, it's obvious that none of these people that we've elected to office are going to do anything about any of this stuff."
The county is mandated by state and federal law to provide services to illegal immigrants.
Arrowhead Regional Medical Center, the county hospital in Colton, must treat every person that enters the emergency room, regardless of income or immigration status.
The hospital's health care cost for illegal immigrants was nearly $9 million in 2006. Today, that number is about $18 million, said Frank Arambula, the hospital's chief financial officer.
The hospital gets back about $5 million from Section 1011 of the Medicare program, which helps reimburse hospitals for emergency services provided to illegal immigrants.
Illegal immigrants make up about 1,400 emergency room patients a year, which equates to about 5 percent of total admissions, Arambula said.
"Is it a strain on our resources to provide these services? No," Arambula said. "Our mission is to take care of the sick who can't pay for health care. If someone doesn't have treatment, they could potentially infect others."
The county pays a hefty price to provide other services to illegal immigrants.
The District Attorney's Office spends about $9 million a year to prosecute cases against illegal immigrants charged with crimes, according to the 2006 Grand Jury report.
District attorney's spokeswoman Susan Mickey said she could not provide an updated cost.
"No one here has any idea where that ($9 million) figure came from," Mickey said. "We do not track cases by immigration status. We do not track by ethnicity or race or anything. If they break the law, they're prosecuted, whether they're legal or illegal."
The county Public Defender's Office also spends $9 million a year to provide criminal defense for illegal immigrants who can't afford their own lawyers, the report said.
County spokesman David Wert could not provide an updated cost.
Wert said the numbers provided to the Grand Jury were one-time estimates provided by the county administrative office at the Grand Jury's request. The county does not track costs for the Public Defender's Office because the county must provide services and there is no reimbursement from the federal government, Wert said.
Tracking costs is also extremely difficult because determining immigration status is a separate legal process, Wert said.
The Sheriff's Department does track the cost to jail illegal immigrants. Sheriff's employees undergo special training by U.S. Immigration and Customs Enforcement to determine the immigration status of inmates for purposes of reimbursement.
In the 2007-2008 fiscal year, the county spent $15.8 million to jail illegal immigrants but only got back $2.2 million from the federal government.
"It has a huge impact on the county and especially the Sheriff's Department budget," said sheriff's spokeswoman Cindy Beavers. "It also taxes our jail population."
In recent years, the department has left more vacant positions unfilled and cut back on some crime-prevention and community programs as a result of not being fully reimbursed for the cost of jailing illegal immigrants, Beavers said.
For the first time, the county is seeking federal reimbursement for probation services provided to juvenile illegal immigrants. County officials are requesting $5.5 million this year to cover that cost.
Assemblyman Steve Knight, R-Palmdale, blamed the federal government and Democrats in the state Legislature for not dealing with the immigration crisis.
"They don't want to take this seriously," said Knight, whose district includes Victorville and Adelanto. "Unfortunately, counties like Los Angeles and San Bernardino are taking the brunt of a lot of this cost. How many of the basic services we provide are being stripped away because we're spending our money on illegal immigrants?"
Rep. Gary Miller, R-Brea, said citizens deserve to know how many of their tax dollars are spent on illegal immigrants.

Senate Immigration Bill Would Allow 100 Million New Legal Immigrants over the Next Twenty Years

(Update: On Tuesday, May 16, the Senate passed Sen. Jeff Bingaman's (D-NM) amendment to S. 2611 that significantly reduced the number of legal immigrants who could enter under the bill's "guest worker" program. As a result of this change, our estimate of the number of legal immigrants who would enter the country or would gain legal status under S. 2611 falls from 103 million to around 66 million over the next 20 years.)

If enacted, the Comprehensive Immigration Reform Act (CIRA, S.2611) would be the most dramatic change in immigration law in 80 years, allowing an estimated 103 million persons to legally immigrate to the U.S. over the next 20 years—fully one-third of the current population of the United States.

Much attention has been given to the fact that the bill grants amnesty to some 10 million illegal immigrants. Little or no attention has been given to the fact that the bill would quintuple the rate of legal immigration into the United States, raising, over time, the inflow of legal immigrants from around one million per year to over five million per year. The impact of this increase in legal immigration dwarfs the magnitude of the amnesty provisions.

In contrast to the 103 million immigrants permitted under CIRA, current law allows 19 million legal immigrants over the next twenty years. Relative to current law, then, CIRA would add an extra 84 million legal immigrants to the nation’s population.

The figure of 103 million legal immigrants is a reasonable estimate of the actual immigration inflow under the bill and not the maximum number that would be legally permitted to enter. The maximum number that could legally enter would be almost 200 million over twenty years—over 180 million more legal immigrants than current law permits.

Immigration Status
To understand the provisions of CIRA, largely based on a compromise by Senators Chuck Hagel (R–Nebraska) and Mel Martinez (R–Florida), it is useful to distinguish between the three legal statuses that a legal immigrant might hold:

1. Temporary Status: Persons in this category enter the U.S. temporarily and are required to leave after a period of time.

2. Near-Permanent, Convertible Status: Persons in this category enter the U.S. and are given the opportunity to “adjust” or convert to legal permanent residence after a few years.

3. Legal Permanent Residence (LPR): Persons in this category have the right to remain in the United States for their entire lives. After five years, they have the right to naturalize and become citizens. As naturalized citizens, they have the constitutional rights to vote and to receive any government benefits given to native-born citizens.
A key feature of CIRA is that most immigrants identified as “temporary” are, in fact, given convertible status with a virtually unrestricted opportunity to become legal permanent residents and then citizens.

Another important feature of both CIRA and existing immigration law is that immigrants in convertible or LPR status have the right to bring spouses and minor children into the country. Spouses and dependent children will be granted permanent residence along with the primary immigrant and may also become citizens. In addition, after naturalizing, an immigrant has the right to bring his parents into the U.S. as permanent residents with the opportunity for citizenship. There are no numeric limits on the number of spouses, dependent children, and parents of naturalized citizens that may be brought into the country. Additionally, the siblings and adult children (along with their families) of naturalized citizens and the adult children (and their families) of legal permanent residents are given preference in future admission but are subject to numeric caps.

Key Provisions of CIRA
Four key provisions of CIRA would result in an explosive increase in legal immigration.

Amnesty for Current Illegal Immigrants: CIRA offers amnesty and citizenship to 85 percent of the nation’s current 11.9 million illegal immigrants. Under the plan, illegal immigrants who have been in the U.S. for five years or more (60 percent of illegals) would be granted immediate amnesty. Illegal immigrants who have been in the country between two and five years (25 percent of illegals) could travel to one of 16 “ports of entry,” where they would receive amnesty and lawful work permits.[1] In total, the bill would grant amnesty to 85 percent of the current illegal immigrant population, or some 10 million individuals.

After receiving amnesty, illegal immigrants would spend six years in a provisional status before attaining LPR status. After five years in LPR status, they would have the opportunity to become naturalized citizens and vote in U.S. elections. As well, the spouses and dependent children of current illegal immigrants would have the right to enter the U.S. and become citizens.[2] There would be no numeric limit on the number of illegal immigrants, spouses, and dependents receiving LPR status; under the amnesty provision, such individuals would not be counted against any other cap or limit in immigration law.[3]

The New “Temporary Guest Worker” Program: CIRA creates an entirely new “temporary guest worker” (H-2C) program. There is nothing temporary about this program; nearly all “guest workers” would have the right to become permanent residents and then citizens.

Foreign workers could enter the U.S. as guest workers if they have a job offer from a U.S. employer. In practical terms, U.S. companies would recruit foreign workers to enter the guest worker program and immigrate to the U.S. Most likely, intermediate employment firms would specialize in recruiting foreign labor for U.S. employers.

Guest workers would be allowed to remain in the U.S. for six years.[4] However, in the fourth year, the guest worker could ask for LPR status and would receive it if he has learned English or is enrolled in an English class.[5] There are no numeric limits on the number of guest workers who could receive LPR status. Upon receiving LPR status, the guest worker could remain in the country permanently. He could become a U.S. citizen and vote in U.S. elections after just five more years.

The spouses and minor children of guest workers would also be permitted to immigrate to the U.S.[6] When guest workers petition for LPR status, their spouses and children would receive it as well. Five years after obtaining LPR status, these spouses could become naturalized citizens. The bill sets no limit on the number of spouses and children who could immigrate under the guest worker program. After workers and their spouses have obtained citizenship, they would be able to bring in their parents as legal permanent residents.

The bill does provide numeric limits on the number of guest workers who can enter the country each year, but the number starts high and then grows exponentially. In the first year, 325,000 H-2C visas would be given out, but if employer demand for guest workers is high, that number could be boosted by an extra 65,000 in the next year. If employer demand for H-2C workers continues to be high, the number of H-2C visas could be raised by up to 20 percent in each subsequent year.

The 20 percent exponential escalator provision allows the number of H-2C immigrants to climb steeply in future years. If the H-2C cap were increased by 20 percent each year, within twenty years the annual inflow of workers would reach 12 million. At this 20 percent growth rate, a total of 70 million guest workers would enter the U.S. over the next two decades and none would be required to leave. While it is unlikely that so many workers would enter, the program does have the potential to bring ten of millions of immigrants to the U.S.

The “guest worker” program, then, is an open door program, based on the demands of U.S. business, that would allow an almost unlimited number of workers and dependents to enter the U.S. from anywhere in world and become citizens. It is essentially an “open border” provision.

Additional Permanent Visas for Siblings, Adult Children, and their Families: The permanent entry of non-immediate relatives—such as brothers, sisters, and adult children—is currently subject to a cap of 480,000 per year minus the number of immediate relatives (the parents, spouses, and minor children of U.S. citizens) admitted in the prior year. CIRA eliminates the deduction for immediate relatives from the cap.[7] This effectively increases the number of non-immediate relatives who could attain LPR status by 254,000 per year.

Additional Permanent Employment Visas: The U.S. currently issues around 140,000 employment-based visas each year. Under CIRA, the U.S. would issue 450,000 employment-based green cards per year between 2007 and 2016.[8] After 2016, the number would fall to 290,000 per year.[9] Under current law, LPR visas going to the spouses and children of workers with employment-based visas are counted against the cap. Under CIRA, these spouses and children would be removed from the cap and given legal permanent residence without numeric limits.[10] Historically, 1.2 dependent relatives have entered the U.S. for each worker under employment-based immigration programs.[11] This means that some 990,000 persons per year would be granted LPR status until 2016 and, after that, 638,000 per year.

Estimating Future Immigration Under CIRA
Most provisions of CIRA are straightforward; in many categories, the number of future immigrants allowed is either directly stated or can be easily calculated from the law’s provisions. In some areas, however, the law’s impact is uncertain. To estimate future legal immigration under the bill, three assumptions have been used in this paper:

• Spouses and children of workers: Dependent spouses and children represent a major component of current immigration. In the current employment-based visa program, 1.2 dependents enter for each incoming worker.[12] This paper assumes this ratio will continue in the employment-based program and will also apply to those entering under the new guest worker program. This is a conservative assumption: guest workers are likely to have lower education levels and thus to have larger families. Finally, many current illegal immigrants who would receive amnesty under the bill already have families in the U.S.; therefore the ratio of incoming spouses and children to amnesty recipients is assumed to be only 0.6, or half the ratio of the employment-based program.

• Parents of naturalized citizens: Parents of naturalized citizens currently make up eight percent of all new legal immigrants. This paper assumes that half of all adult immigrants will naturalize after five years of LPR status and that 30 percent of the parents of these naturalized citizens will immigrate in the three years after their children’s naturalization.

• Growth in the guest worker program: The number of immigrants in the guest worker program will be driven by employer demand. The bill allows the number of H-2C visas to increase by 20 percent per year; this level of growth would result in an extraordinary 60 million guest workers in the U.S. over the next twenty years. This paper assumes that the number of immigrants in the guest worker program would increase at a more moderate rate of 10 percent per year. Alternative estimates for 20 percent growth and zero growth in the program are also presented.[13]
A Flood of Legal Immigrants
Under CIRA, immigrants could enter the country or attain lawful status within the country through eight channels. In each channel, immigrants would be granted permanent residence and the right to become citizens. The first channel represents immigrants who would have entered under current law; the second channel represents illegal immigrants who are currently in the country and would be given legal permanent residence under the bill. The other six channels represent new inflows of legal immigrants that would occur as a result of the bill. The total number of new legal immigrants over a twenty year period would be as follows: (See Charts 1 and 2.)


1. Visas under current law: Roughly 950,000 persons receive permanent residence visas under current law each year. Over 20 years, the inflow of immigrants through this channel would be 19 million. This represents the status quo under existing law.

2. Amnesty: The bill would grant amnesty to roughly 10 million illegal immigrants. These individuals are currently living in the U.S.; amnesty would allow them to remain legally and to become U.S. citizens.

3. Expanded family chain migration: The number of family-sponsored visas for secondary family members, such as adult brothers and sisters, is currently limited to 480,000 per year minus the number of visas given to immediate family members (spouses, minor children, and parents of U.S. citizens). The bill changes the law so that the total quota on secondary family members would be 480,000 without deductions for immediate family members. The net increase in the number of immigrants under this provision would be around 254,000 per year, or 5.1 million over 20 years.[14]

4. Employment-based green cards: The bill would increase the number of employment-based visas from 140,000 to 450,000 per year. For the first time, it would also exempt the spouses and children of workers from the cap. Total annual immigration under this provision is likely to be 450,000 workers plus 540,000 family members annually. The net increase above current law over 20 years would be around 13.5 million persons.[15]

5. The guest worker (H-2C) program: CIRA would allow 325,000 persons to participate in the guest worker program in the first year. This number could rise by 65,000 in the next year and then by 20 percent per year. Assuming 10 percent annual growth in the annual number of guest workers entering the country (well below the bill’s maximum), the total inflow of workers under this program would be 20 million over 20 years.

6. Spouses and children of guest workers: Guest workers could bring their spouses and children to the U.S. as permanent residents; the added number of entrants would be 24 million over 20 years.

7. Spouses and children of illegal immigrants given amnesty: Illegal immigrants who received amnesty could bring their spouses and children into the U.S. as legal permanent residents with the opportunity for full citizenship. The number of spouses and children who would enter the U.S. as a result of amnesty would be at least six million.

8. Parents of naturalized citizens. The bill would substantially increase the number of naturalized citizens. Naturalized citizens would have an unlimited right to bring their parents into the U.S. as legal permanent residents. Over twenty years, the number of parents who would enter the U.S. as permanent legal residents as a result of CIRA would be around five million.
Overall, the bill would allow some 103 million persons to legally immigrate over the next twenty years. This is roughly one-third of the current population of the United States. All of these new entrants would be permanent residents and would have the right to become citizens. This would be a 84 million person net increase over current law.

Legal Flow Compared to Illegal Immigration
All of the immigration discussed to this point would be legal immigration. If illegal immigration continued after enactment of S.2611, the inflow of immigrants would be even greater. Although illegal immigration is considered a major problem, the proposed legal immigration under CIRA would dwarf it numerically. The net inflow of illegal immigrants into the U.S. population is around 700,000 per year.[16] Legal immigration under CIRA would exceed five million per year, seven times the rate of the current illegal immigration flow. Annual legal and illegal immigration together now equals about 1.7 million; future legal immigration alone under CIRA would be three times this amount.

Range of Estimates
The figure of 103 million new legal immigrants is based on the assumption that immigration under the guest worker program would grow at 10 percent per year. If guest-worker immigration grows at the maximum rate permitted by the bill, 20 percent per year, the total number of new immigrants coming to the U.S. over the next twenty years would be 193 million. On the other hand, if immigration under the H-2C program did not increase at all for two decades but remained fixed at the initial level of 325,000 per year, total legal immigration under CIRA would be 72 million over twenty years, or more than three times the level that would occur under current law. (See Chart 3.)

The tables in the Appendix show annual inflows of total legal immigrants in each of the eight channels mentioned above over the next twenty years. The tables show the estimated yearly rate of immigration under three scenarios for the H-2C program: zero growth, ten percent growth, and twenty percent growth.

Dwarfing the Great Migration
Between 1870 and 1920, the U.S. experienced a massive flow of immigration known as the “great migration”. During this period, foreign born persons hovered between 13 and 15 percent of the population.[17]In 1924, Congress passed major legislation greatly reducing future immigration. By 1970, foreign born persons had fallen to 5 percent of the population.

In the last three decades, immigration has increased sharply. The foreign born now comprise around 12 percent of the population, approaching the levels of the early 1900’s. However, if CIRA were enacted, and 100 million new immigrants entered the country over the next twenty years, foreign born persons would rise to over one quarter of the U.S. population.[18] There is no precedent for that level of immigration at any time in U.S. history.

Conclusion
If enacted, CIRA would be the most dramatic change in immigration law in 80 years. In its overall impact on the nation, the bill would rival other historic milestones, such as the creation of Social Security or Medicare.

The bill would give amnesty to 10 million illegal immigrants and quintuple the rate of legal immigration into the U.S. Under the bill, the annual inflow of immigrants with the option of becoming legal permanent residents would rise from the current level of one million per year to more than five million per year. Within a few years, the annual inflow of new immigrants would exceed one percent of the current U.S. population. This would be the highest immigration rate in U.S. history.

Within 20 years, some 103 million new immigrants would enter the U.S. This number is about one-third of the current U.S. population. All of these immigrants would be permanent residents with the right to become citizens and vote in U.S. elections. CIRA would transform the United States socially, economically, and politically. Within two decades, the character of the nation would differ dramatically from what exists today.

AMERICAN JOBS IN PERIL: The Impact of UNCONTROLLED IMMIGRATION

House Judiciary Republicans Hold Immigration Forum on Capitol Hill
On Thursday, November 19, Republican Members of the House Judiciary Committee held a forum entitled “American Jobs in Peril: The Impact of Uncontrolled Immigration.” The forum allowed several experts to offer testimony regarding the negative consequences that unrestricted mass immigration – both legal and illegal – has had on American workers.
House Judiciary Committee Ranking Member Lamar Smith (R-TX) opened the hearing by discussing data that the Department of Homeland Security’s (DHS) Bureau of Immigration and Customs Enforcement (ICE) had released earlier in the week. Smith pointed out that, while the nationwide unemployment rate has increased more than 60 percent from Fiscal Year (FY) 2008 to FY 2009, the number of criminal arrests, criminal indictments, criminal convictions, and administrative arrests of illegal alien workers as a result of ICE worksite enforcement operations had all decreased by at least 58% during that same time period. (House Judiciary Committee – Minority Press Release, November 18, 2009). Smith argued that with 16 million Americans out of work, the Obama administration should be increasing worksite enforcement to free up jobs held by the estimated eight million illegal aliens currently working in the United States.
Four expert witnesses testified at the hearing. The first was Dr. Carol Swain, a professor of Political Science and Law at Vanderbilt University. Dr. Swain’s testimony focused on the unemployment rates of African Americans and native-born Hispanics – two groups she said were particularly hard-hit by the current recession. Dr. Swain noted that “[r]acial and ethnic minorities are overrepresented among Americans suffering from high levels of unemployment,” and added that “[i]t is this group of native-born workers who are most adversely impacted by competition from unauthorized workers.” Dr. Swain then called on “Democrats and Republicans, members of the Congressional Black and Congressional Hispanic Caucuses to join forces in pressing for the enforcement of existing immigration laws and regulations already on the books.” The professor recommended that E-Verify – the online, electronically operated system that allows employers to quickly and easily confirm the work authorization status of their new hires – “should be made mandatory and expanded across the nation.”

Camarota noted that, over the past four decades, the United States has “witnessed a dramatic increase in the number of immigrants (both legal and illegal) arriving.” Camarota pointed out that “almost all economists agree that less-educated workers have done very poorly in the labor market over the last four decades as immigration has increased.”

Steven A. Camarota, the Director of Research at the Center for Immigration Studies, was the next witness to testify. Camarota noted that, over the past four decades, the United States has “witnessed a dramatic increase in the number of immigrants (both legal and illegal) arriving.” Camarota pointed out that “almost all economists agree that less-educated workers have done very poorly in the labor market over the last four decades as immigration has increased.” Echoing Dr. Swain’s testimony, Camarota then highlighted “significant research showing that immigration has reduced employment and wages for less-educated natives.” Camarota also dismissed the claims of special interest groups that have advocated for amnesty and large-scale increases in legal immigration, pointing out that “[t]here is no evidence of a labor shortage at the bottom end of the labor market.”
Roy Beck, President of NumbersUSA, testified next and highlighted three “key numbers.” The first number was eight million, the Pew Hispanic Center’s estimate as to the number of illegal foreign workers holding American jobs. (Pew Hispanic Center, April 14, 2009). Beck’s second number was 75,000, the estimated number of permanent work permits issued to working-age immigrants in the month of October. (DHS – Office of Immigration Statistics, March 2009). The third number was 190,000, the number of American jobs eliminated in the month of October. (Bureau of Labor Statistics, November 6, 2009). Accordingly, Beck argued, the federal “government added 75,000 more permanent workers to compete with 16 million unemployed Americans for 190,000 FEWER U.S. jobs.” (Testimony, November 19, 2009).
The final witness to testify at the forum was Jerry Kammer, a Senior Research Fellow at the Center for Immigration Studies. Kammer highlighted two separate reports discussing how local labor markets were affected by immigration enforcement. (See reports from July 2009 and March 2009). Kammer discussed how worksite enforcement operations conducted at seven meat packing plants in seven states had resulted in the arrests of thousands of illegal alien workers, providing “an opportunity to test the claim, often heard in the immigration debate, that many American businesses have to hire illegal immigrants because Americans are unwilling to do the work.” Kammer pointed out that the meat packing plants filled the jobs formerly held by illegal aliens with American citizens and legal immigrants, and that immigration enforcement had led to increased wages and improved working conditions at the plants in question. Once again: Obama and the jobs crisis

The Obama administration has flatly rejected appeals for the federal government to take any direct action to create jobs and alleviate the mounting toll of unemployment in the United States. Obama reiterated this position in his Saturday radio/Internet address, and it was echoed by top aides in media interviews over the weekend.
White House Chief of Staff Rahm Emanuel told the Wall Street Journal, “There are two engines to our economic message, two ways to generate jobs. One is small business, the second is energy.” He implicitly rejected any suggestion of direct government hiring for public works projects in favor of tax credits or eased lending terms for private, profit-making businesses.
The Journal article published Monday began: “The White House is lukewarm about proposals by congressional Democrats to introduce broad legislation to create jobs, instead favoring targeted measures that would be less likely to inflate the deficit, administration officials said.” Besides Emanuel, the newspaper cited opposition by Treasury Secretary Timothy Geithner to a tax on financial transactions that would finance a jobs program, as proposed by some House Democrats.
Obama’s Saturday speech was remarkable for its callous indifference to the plight of the unemployed. He gave lip service to the problem, declaring at the beginning, “As we emerge from the worst recession in generations, there is nothing more important than to do everything we can to get our economy moving again and put Americans back to work.”
“Everything we can” turns out to be little more than talk—a White House forum on jobs, to be held December 3, and perhaps more tax cuts for corporate interests. “In order to keep growing, we need to spend less, save more, and get our federal deficit under control,” Obama said. “It is important that we do not make any ill-considered decisions—even with the best of intentions—particularly at a time when our resources are so limited,” he concluded.
“Limited resources” were not a consideration when it came to bailing out Wall Street. The US Treasury and the Federal Reserve made available trillions to the financial institutions. But when it comes to the working class, Obama has repeatedly demanded austerity measures.
The administration forced General Motors and Chrysler into bankruptcy and imposed sweeping wage and benefit cuts on the auto workers. Obama has insisted that any health care legislation “not add a dime to the deficit,” and now the White House rejects any direct job-creation measures in the name of reducing the deficit.
The barely concealed contempt of Obama and other top administration officials for working people is all the more remarkable under conditions of double-digit unemployment and reports that 49 million Americans faced hunger last year and that home foreclosures are continuing at record rates. The jobs crisis is downplayed as a “lagging economic indicator.” The hunger report, released last week, evoked a perfunctory response from Obama, who warned that worsening malnutrition among children was dangerous because it threatened America’s global competitiveness.
Meanwhile, Obama congratulates himself for restabilizing the banks while Wall Street reaps bumper profits and prepares to award its executives and traders with record bonuses next month, secure in the knowledge that the administration opposes any real restrictions on bankers’ pay.
Obama voiced his hard line against new spending to create jobs in an interview during his China trip with the right-wing Fox News. “There may be some tax provisions that can encourage businesses to hire sooner rather than sitting on the sidelines. So we’re taking a look at those,” he said. “I think it is important, though, to recognize if we keep on adding to the debt, even in the midst of this recovery, that at some point, people could lose confidence in the US economy in a way that could actually lead to a double-dip recession.”
It is no accident that Obama took time from his China trip to reiterate his opposition to any major increase in social spending. This was in large part intended to reassure the Chinese, who hold some $800 billion in Treasury notes and are the biggest creditor of the United States.
Central to the global strategy of the American ruling class, which has more than doubled the federal deficit in order to bail out the banks, is a sharp reduction in the wages and living standards of American workers, whose conditions must be brought more closely in line with those of super-exploited workers in Asia. On the basis of what Obama calls “lower consumption,” the US is to pare down its debt and transform itself into a cheap-labor center for exports to the world market.
This policy of “everything for the banks, nothing for jobs” is so blatantly hostile to the working class that some of Obama’s nominally liberal supporters have issued appeals for the president to change course, warning that otherwise he risks a social and political explosion.
Congressman Peter DeFazio of Oregon told CNN, “It’s pretty embarrassing for a Democratic administration and a Democratic Congress to be identified with total attention to Wall Street and nothing for Main Street and jobs.”
A joint statement by the AFL-CIO, NAACP and four other organizations, issued November 16, urged Obama to adopt a five-point jobs program, including an effort to “directly create jobs that put people to work helping communities meet pressing needs, especially in distressed communities facing severe unemployment.”
Perhaps the most remarkable expression of concern came from economist Paul Krugman, a columnist for the New York Times who has been a fervent supporter of Obama’s health care plan. He took note of Obama’s comments to Fox News about the danger of growing federal deficits, then observed: “It took me a while to puzzle this out. But the concerns Mr. Obama expressed become comprehensible if you suppose that he’s getting his views, directly or indirectly, from Wall Street.”
Krugman has blurted out the real social base of the Obama administration. Obama, Emanuel, Geithner & Co. echo the views of bankers and speculators because that is whom they represent and serve. Obama heads an administration of, by and for the most powerful financial interests.
This is not a government of reform that is being led astray by right-wing pressure, or can be pushed to the left by counter-pressure from below. It is a government of social and political reaction.
Ultimately, the policies of the Obama administration are determined by the objective historical decline of American capitalism. Even in the depths of the Great Depression, the Roosevelt administration could enact limited social reform policies because it had at its disposal the vast economic reserves of American capitalism, then the industrial powerhouse of the world.
In the intervening decades, the United States has undergone a dramatic economic decline, expressed in its most concentrated form in the decay of its industrial base and the transformation of the US into the global center of financial speculation and parasitism. The result is unprecedented levels of social inequality, relentless attacks on the conditions of the working class, and the rise of a financial aristocracy that dominates the political system and dictates basic government policy.
The Obama administration embodies this process. Its social and economic policies demonstrate that the US ruling elite is incapable either of reforming itself—by curbing the profit-gouging on Wall Street that triggered the financial crisis—or of providing social reforms that would benefit the masses of working people.

Obama’s refusal to take action on the jobs crisis and his undisguised indifference to the suffering which has swept over working class America are increasingly recognized by millions of working people. Initially, this is reflected in plummeting poll numbers. Soon enough, it will be expressed in the eruption of major struggles as workers and young people abandon illusions in the phony promises of “hope” and “change” and take action to defend their independent social and class interests.

Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Mexicans Say Amnesty Will Boost Illegal Immigration

If President Obama keeps his promise of giving the nation’s 12 million illegal aliens amnesty it will encourage more Mexicans to enter the United States, according to residents of the struggling Latin American country who are undoubtedly rooting for the commander-in-chief’s plan.
The majority of illegal immigrants in the U.S. are from Mexico therefore the president’s reprieve project will greatly affect that nation. Two-thirds of Mexicans say they know someone living in the United States and around one-third have an immediate member of their household or close relative living in the U.S.
A majority of those residing south of the border say legalizing their undocumented countrymen will inspire more Mexicans to head north, according to a recent survey conducted by an internationally known polling and market research company. A vast majority of Mexicans with a relative in the United States said a legalization program would make people they know more likely to go to America illegally.
The results of the survey were made public this week by a research organization dedicated to studying the economic, social, fiscal and demographic impacts of immigration in the U.S. It reveals that nearly one-third of Mexican residents (nearly 40 million people) would like to live in the U.S. and if there was an amnesty a large number would come illegally with the hope of qualifying for a future exoneration.
An amnesty, therefore, would stimulate more illegal immigration which is the last thing this country needs. Furthermore, rewarding those who have violated our nation’s laws with coveted U.S. residency and possibly citizenship demeans the system, especially for those who follow the appropriate steps to come lawfully.
It’s bad enough that U.S. taxpayers annually dish out billions of dollars to educate, medically treat and incarcerate illegal aliens who are, in many cases, depleting local governments. Los Angeles County alone spends more than $1 billion a year, including $48 million a month in welfare costs, to provide services for illegal aliens. The crisis is hardly limited to border states, which have traditionally been the most impacted. Georgia’s skyrocketing illegal population costs taxpayers nearly $2 billion a year.

Study: Illegal alien population may be as high as 38 million A new report finds the Homeland Security Department "grossly underestimates" the number of illegal aliens living in the U.S. Homeland Security's Office of Immigration Studies released a report August 31 that estimates the number of illegal aliens residing in the U.S. is between 8 and 12 million. But the group Californians for Population Stabilization, or CAPS, has unveiled a report estimating the illegal population is actually between 20 and 38 million. Four experts, all of whom contributed to the study prepared by CAPS, discussed their findings at a news conference at the National Press Club in Washington Wednesday. James Walsh, a former associate general counsel of the Immigration and Naturalization Service, said he is "appalled" that the Bush administration, lawyers on the Senate Judiciary Committee, and every Democratic presidential candidate, with the exception of Joe Biden, have no problem with sanctuary cities for illegal aliens. "Ladies and gentlemen, the sanctuary cities and the people that support them are violating the laws of the United States of America. They're violating 8 USC section 1324 and 1325, which is a felony -- [it's] a felony to aid, support, transport, shield, harbor illegal aliens," Walsh stated. Walsh said his analysis indicating there are 38 million illegal aliens in the U.S. was calculated using the conservative estimate of three illegal immigrants entering the U.S. for each one apprehended. According to Walsh, "In the United States, immigration is in a state of anarchy -- not chaos, but anarchy."

Mexico Promotes Free U.S. Healthcare For Illegal Immigrants

Time to wake up people! With unemployment at 12% and the state going broke, our tax dollars are going to pay for healthcare for hundreds of thousands of illegal aliens. To the tune of over a billion dollars a year!

Mexico's government operates programs in about a dozen American cities that refers its nationals--living in the U.S. illegally--to publicly funded health centers where they can get free medical care without being turned over to immigration authorities.

The program is called Ventanillas de Salud (Health Windows) in Spanish and its mission is to help illegal immigrants find U.S. hospitals, clinics and other government programs where they can get free services without being deported for violating federal immigration laws.

Chicago, Houston, Los Angeles, San Diego and Indiana are among the cities where Mexican consulates operate the health referral system which annually costs U.S. taxpayers billions of dollars. In Los Angeles County alone, illegal immigrants cost taxpayers nearly $440 million in health services annually and a whopping $1.1 billion statewide.

The Mexican consul in Los Angeles proudly announced that nearly 300,000 Mexicans in the area have benefited from his government's health referral program, which he says actually saves the county money by encouraging immigrants to seek preventive care rather than waiting for more expensive emergency treatment.

The Southern California operation promises to assess "consulate clients" for eligibility to government-funded health insurance and other primary care services and offers free legal assistance to those who are denied coverage. Its goal is to improve access to health services for immigrants of Mexican origin by formalizing a health education, medical home referral and insurance enrollment program.

In Chicago, the Mexican consul's Spanish-language web site heavily promotes the Illinois Department of Health's low-cost prescription medicine program for illegal aliens and various free medical services throughout the state. It encourages all Mexicans in the area to pursue the valuable U.S. government-financed services for their entire family.

The Indiana-based program boasts that it serves thousands of "Mexican nationals" living in that state as well as Ohio, Kentucky and southern Illinois. Mexican officials claim that its highly successful pro-health program sends out a clear message to other Mexican consulates throughout the country and the world.

Although these programs facilitate people to remain in the country illegally, Mexico is working hard to expand them to all 47 U.S. consulates to better serve its nationals. In the meantime, U.S. taxpayers will keep picking up the exorbitant tab of medically treating the millions who live in the country illegally.

WASHINGTON, Sept. 8 /PRNewswire-USNewswire/ -- As President Obama addresses the nation on health care reform, a new analysis by the Center for Immigration Studies estimates that 6.6 million uninsured illegal immigrants could receive benefits under the House health reform bill (H.R. 3200). While the bill states that illegal immigrants are not eligible for the new taxpayer-funded affordability credits, there is nothing in the bill to enforce this provision. Congress defeated efforts to require the use of the Systematic Alien Verification for Entitlements (SAVE) program. More than 70 other programs of this kind use SAVE.

-- In 2007, there were an estimated 6.6 million illegal immigrants without
health insurance who had incomes below 400 percent of poverty, which is
the income ceiling for the new affordability premium credits.
-- If all uninsured illegal immigrants with incomes below 400 percent of
poverty received the new credits, the estimated cost to the federal
government would be $30.5 billion annually.
-- The current cost of treating uninsured illegal immigrants at all levels
of government is an estimated $4.3 billion a year, primarily at
emergency rooms and free clinics.
-- On July 16 an amendment by Rep. Dean Heller (R-NV) that would have
required the use of the Systematic Alien Verification for Entitlements
(SAVE) program to prevent illegal immigrants from receiving the
affordability credits was defeated by the House Ways and Means
Committee.
-- At present 71 other means-tested federal programs require use of the
SAVE system to prevent illegal immigrants and other ineligible
non-citizens from accessing them.
-- Even though there is no mechanism to prevent enrollment, it is likely
that many income-eligible illegal immigrants would not enroll out of
fear or lack of knowledge of the new programs. Thus the actual costs
would be less than the maximum estimate of $30.5 billion. However, if
illegal immigrants are legalized and could receive affordability
credits, a much larger percentage would be expected to enroll, with a
corresponding increase in costs.
-- Uninsured illegal immigrants tend to use less in health care on average
than others without health insurance because they tend to be young. This
fact is incorporated into the current cost estimate of $4.3 billion.
However, government-provided affordability credits paid to insurance
companies are the same for everyone regardless of age or preexisting
conditions. Therefore, the younger age of illegals does not result in
lower average costs for taxpayers for this program.
-- It is also worth noting that the report estimates that 38 percent of
illegal immigrants had health insurance in 2007. Additionally, the
report estimates that there are at least 360,000 uninsured illegal
immigrants with incomes above 400 percent of poverty who would not
qualify for benefits under H.R. 3200.
-- It is also possible that illegal immigrants could benefit from the
expansion of Medicaid under H.R. 3200. The bill does not require
identity verification for those claiming U.S. birth. Of illegal
immigrants with incomes under 400 percent of poverty, about half live
under 133 percent of poverty, which is the new ceiling for Medicaid
eligibility.
-- On July 30 an amendment by Rep. Nathan Deal (R-GA) that would have
required identity variation for those claiming U.S. birth was defeated
by the House Energy and Commerce Committee.
Methodology: To estimate the number of illegal immigrants in the United States this report uses the March 2008 Current Population Survey (CPS) collected by the Census Bureau. While the CPS does not ask the foreign-born if they are legal residents, the Department of Homeland Security (DHS), former INS, and other outside researchers have all used socio-demographic characteristics in Census Bureau data to estimate the size of the illegal alien population; this report follows the same approach. The March CPS also asks about income and health insurance coverage and on this basis the report estimates the share of low-income illegal immigrants who are without health insurance coverage.
