MISSOURI SHERIFF ARRESTS ILLEGALS - FEDS ORDER RELEASED - OUR OPEN & UNDEFENDED BORDERS

Missouri sheriff arrests illegal laborers, feds order them released!!! (Proud USA)

Last weekend, St. Francois County Sheriff Daniel Bullock arrested 14 illegal aliens, the men were working on a construction site, where a new Hampton Inn is being built.

Sheriff Bullock told a reporter that he wanted to see the jobs go to legal residents. St. Francois County has been hard-hit by this country’s deep recession. The county has an unemployment rate of more than 11 percent.

However, when the sheriff reported the arrests to Immigration and Customs Enforcement, he was told by the federal agency that they were not interested, and furthermore, he had no authority to hold the illegal aliens.

Unemployed glass worker Gerald Bowyer, told KTVI: “They're taking jobs away from people that need jobs right now that are US citizens. To me, it seems like the illegals in this country got more rights than what the Americans do.”

Many county residents are angry over the incident and believe that illegal labor has been used for quite a while on the new hotel.

Bob Meynell, of Carpenters' District Council of Greater St. Louis, said: “Our unemployment rate right now is 11.1%. When the local police would drive by you would hear all the whistles on the job site and you'd turn around to look and 6 or 7 of them were hiding.”

Despite the disappointing reaction from ICE, Sheriff Bullock said he will continue to look for illegal alien labor in the county.

“I've been hearing stories of this for the last several months officers picking up illegals and then just turning them loose,” Bullock said. “Somewhere along the line our legislators need to change the way things are done.”

Congressman Derided for Laughing at Suggestion to Recite the Pledge of Allegiance
A Republican candidate for Congress in California is calling on U.S. Rep. Xavier Becerra to "clarify his reaction" after the Democrat was caught on a YouTube video laughing at a suggestion that the Pledge of Allegiance be recited prior to a union meeting in Los Angeles.
If the Pledge of Allegiance is a laughing matter, then the joke may be on a California congressman.
A Republican candidate for Congress in California is calling on U.S. Rep. Xavier Becerra to "clarify his reaction" after the Democrat was caught on a YouTube video laughing at a suggestion that the Pledge of Allegiance be recited prior to a union meeting in Los Angeles.
The 46-second video was captured by an unidentified staffer who accompanied candidate Ari David to a Service Employees International Union meeting on Saturday. By early Tuesday, the video had been viewed roughly 10,000 times.
David will not be opposing Becerra in November; he is running to replace Democratic U.S. Rep. Henry Waxman in a neighboring district. He said he attended the meeting in Becerra's district in hopes of meeting with Waxman, who he said was an invited guest.
On the video, a man off camera can be heard saying: "I'm here for Ari David for Congress. Can we start this meeting with the Pledge of Allegiance?"
Hilarity ensues, most notably on behalf of an unidentified woman standing behind a lectern. Becerra, seated on stage, can be seen smiling and stifling his laughter as he bends slightly forward in his chair.
"No, I'm serious," David's staffer continues. "Congressman, shouldn't we say the Pledge of Allegiance if we all want to be citizens? Wouldn't that be appropriate to say the Pledge of Allegiance?"
"Sure, of course," the woman on stage replies. "OK, let's go for it -- you lead."
The pledge is then recited by everyone in the room, followed by raucous applause.
David told Fox News he found Becerra's reaction "completely inappropriate," adding: "I was stunned as an American that one of our members of Congress would act that way.
"Considering these people want immigration reform, shouldn't they say the national anthem before a public meeting with their elected official there?"
If Becerra thought the situation was comical, it was the congressman's "prerogative" to laugh, David said.
"Is it that offensive of a notion to be asked to say the Pledge of Allegiance?" the candidate continued.
Becerra defended the reaction in a statement to Fox News, saying:
"On the morning of February 20th, I was invited to address some 500 people gathered to discuss the human tragedy of a broken immigration system and the need to fix it. At some point during that meeting, a political operative for a congressional campaign asked if we could recite the pledge of allegiance. The meeting was already under way and the question was unexpected. It took us all by surprise. When the speaker explained that he was serious and asked me specifically if we could say the pledge, I said yes and gestured to the moderator, who then led the entire gathering in reciting the pledge."

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

With the federal government’s persistent refusal to enforce immigration laws, state legislatures across the country continue to address the issue of illegal immigration on their own. Last week, the Virginia House of Delegates and the Arizona State Senate both passed enforcement-oriented legislation.

On Monday, February 15, the Arizona State Senate passed Senate Bill (SB) 1070 by a vote of 17 to 13. (Vote Results). Entitled the “Support Our Law Enforcement and Safe Neighborhoods Act,” SB 1070 would prohibit Arizona police departments from adopting sanctuary policies that prevent officers from asking individuals about their immigration status. SB 1070 would also establish a new state trespassing statute that would make it illegal for any person to be present on any public or private land in Arizona in violation of federal immigration law. (SB 1070; For more on SB 1070, see East Valley Tribune, February 15, 2010). In addition, the Arizona Senate passed another bill, SB 1027, which would require the state’s Department of Public Safety to “seek grants to implement a one-year pilot program that would use seismic sensors to monitor rural airport runways and other rural areas of [Arizona] where illegal drug traffic and illegal alien traffic or human smuggling are likely to occur.” (SB 1027). Both bills have been sent to the Arizona House for further action. (See Bill Status Overviews for SB 1070 and SB 1027). The legislative prospects for the bills are unclear at this point. While SB 1070 has drawn support from the Phoenix Law Enforcement Association and the Arizona Police Association, a similar bill stalled in the Arizona House during the last legislative session after passing through the Senate. (The Arizona Republic, January 21, 2010; KSWT, January 20, 2010).

One day after the action in the Arizona Senate, the Virginia House of Delegates overwhelmingly approved House Bill (HB) 737 by a vote of 82 to 13. (Vote Results). Originally, HB 737 would have required all state agencies, local governments, public contractors, and employers with 15 or more employees to enroll in E-Verify. (HB 737 – Text as Introduced). However, after intense lobbying by big business special interest groups, the House of Delegates passed a pared-down version of the legislation that would require only state agencies and local governments to enroll in E-Verify. (HB 737 – Text as Passed by House). Under the bill, government agencies would be required to enroll in E-Verify before December 1, 2010 and subsequently use E-Verify for each newly hired employee who is to perform work within the state of Virginia. (Id.). The bill has now moved to the Virginia Senate, where it has been referred to the Senate Committee on Commerce and Labor. (Bill Tracking). Millions of Unemployed Face Years Without Jobs

BUENA PARK, Calif. — Even as the American economy shows tentative signs of a rebound, the human toll of the recession continues to mount, with millions of Americans remaining out of work, out of savings and nearing the end of their unemployment benefits.
Economists fear that the nascent recovery will leave more people behind than in past recessions, failing to create jobs in sufficient numbers to absorb the record-setting ranks of the long-term unemployed.
Call them the new poor: people long accustomed to the comforts of middle-class life who are now relying on public assistance for the first time in their lives — potentially for years to come.
Yet the social safety net is already showing severe strains. Roughly 2.7 million jobless people will lose their unemployment check before the end of April unless Congress approves the Obama administration’s proposal to extend the payments, according to the Labor Department.
Here in Southern California, Jean Eisen has been without work since she lost her job selling beauty salon equipment more than two years ago. In the several months she has endured with neither a paycheck nor an unemployment check, she has relied on local food banks for her groceries.
She has learned to live without the prescription medications she is supposed to take for high blood pressure and cholesterol. She has become effusively religious — an unexpected turn for this onetime standup comic with X-rated material — finding in Christianity her only form of health insurance.
“I pray for healing,” says Ms. Eisen, 57. “When you’ve got nothing, you’ve got to go with what you know.”
Warm, outgoing and prone to the positive, Ms. Eisen has worked much of her life. Now, she is one of 6.3 million Americans who have been unemployed for six months or longer, the largest number since the government began keeping track in 1948. That is more than double the toll in the next-worst period, in the early 1980s.
Men have suffered the largest numbers of job losses in this recession. But Ms. Eisen has the unfortunate distinction of being among a group — women from 45 to 64 years of age — whose long-term unemployment rate has grown rapidly.
In 1983, after a deep recession, women in that range made up only 7 percent of those who had been out of work for six months or longer, according to the Labor Department. Last year, they made up 14 percent.
Twice, Ms. Eisen exhausted her unemployment benefits before her check was restored by a federal extension. Last week, her check ran out again. She and her husband now settle their bills with only his $1,595 monthly disability check. The rent on their apartment is $1,380.
“We’re looking at the very real possibility of being homeless,” she said.
Every downturn pushes some people out of the middle class before the economy resumes expanding. Most recover. Many prosper. But some economists worry that this time could be different. An unusual constellation of forces — some embedded in the modern-day economy, others unique to this wrenching recession — might make it especially difficult for those out of work to find their way back to their middle-class lives.
Labor experts say the economy needs 100,000 new jobs a month just to absorb entrants to the labor force. With more than 15 million people officially jobless, even a vigorous recovery is likely to leave an enormous number out of work for years.
Some labor experts note that severe economic downturns are generally followed by powerful expansions, suggesting that aggressive hiring will soon resume. But doubts remain about whether such hiring can last long enough to absorb anywhere close to the millions of unemployed.
A New Scarcity of Jobs
Some labor experts say the basic functioning of the American economy has changed in ways that make jobs scarce — particularly for older, less-educated people like Ms. Eisen, who has only a high school diploma.
Large companies are increasingly owned by institutional investors who crave swift profits, a feat often achieved by cutting payroll. The declining influence of unions has made it easier for employers to shift work to part-time and temporary employees. Factory work and even white-collar jobs have moved in recent years to low-cost countries in Asia and Latin America. Automation has helped manufacturing cut 5.6 million jobs since 2000 — the sort of jobs that once provided lower-skilled workers with middle-class paychecks.
“American business is about maximizing shareholder value,” said Allen Sinai, chief global economist at the research firm Decision Economics. “You basically don’t want workers. You hire less, and you try to find capital equipment to replace them.”
During periods of American economic expansion in the 1950s, ’60s and ’70s, the number of private-sector jobs increased about 3.5 percent a year, according to an analysis of Labor Department data by Lakshman Achuthan, managing director of the Economic Cycle Research Institute, a research firm. During expansions in the 1980s and ’90s, jobs grew just 2.4 percent annually. And during the last decade, job growth fell to 0.9 percent annually.
“The pace of job growth has been getting weaker in each expansion,” Mr. Achuthan said. “There is no indication that this pattern is about to change.”
Before 1990, it took an average of 21 months for the economy to regain the jobs shed during a recession, according to an analysis of Labor Department data by the National Employment Law Project and the Economic Policy Institute, a labor-oriented research group in Washington.
After the recessions in 1990 and in 2001, 31 and 46 months passed before employment returned to its previous peaks. The economy was growing, but companies remained conservative in their hiring.
Some 34 million people were hired into new and existing private-sector jobs in 2000, at the tail end of an expansion, according to Labor Department data. A year later, in the midst of recession, hiring had fallen off to 31.6 million. And as late as 2003, with the economy again growing, hiring in the private sector continued to slip, to 29.8 million.
It was a jobless recovery: Business was picking up, but it simply did not translate into more work. This time, hiring may be especially subdued, labor economists say.
Traditionally, three sectors have led the way out of recession: automobiles, home building and banking. But auto companies have been shrinking because strapped households have less buying power. Home building is limited by fears about a glut of foreclosed properties. Banking is expanding, but this seems largely a function of government support that is being withdrawn.
At the same time, the continued bite of the financial crisis has crimped the flow of money to small businesses and new ventures, which tend to be major sources of new jobs.
All of which helps explain why Ms. Eisen — who has never before struggled to find work — feels a familiar pain each time she scans job listings on her computer: There are positions in health care, most requiring experience she lacks. Office jobs demand familiarity with software she has never used. Jobs at fast food restaurants are mostly secured by young people and immigrants.
If, as Mr. Sinai expects, the economy again expands without adding many jobs, millions of people like Ms. Eisen will be dependent on an unemployment insurance already being severely tested.
“The system was ill prepared for the reality of long-term unemployment,” said Maurice Emsellem, a policy director for the National Employment Law Project. “Now, you add a severe recession, and you have created a crisis of historic proportions.”
Fewer Protections
Some poverty experts say the broader social safety net is not up to cushioning the impact of the worst downturn since the Great Depression. Social services are less extensive than during the last period of double-digit unemployment, in the early 1980s.
On average, only two-thirds of unemployed people received state-provided unemployment checks last year, according to the Labor Department. The rest either exhausted their benefits, fell short of requirements or did not apply.
“You have very large sets of people who have no social protections,” said Randy Albelda, an economist at the University of Massachusetts in Boston. “They are landing in this netherworld.”
When Ms. Eisen and her husband, Jeff, applied for food stamps, they were turned away for having too much monthly income. The cutoff was $1,570 a month — $25 less than her husband’s disability check.
Reforms in the mid-1990s imposed time limits on cash assistance for poor single mothers, a change predicated on the assumption that women would trade welfare checks for paychecks.
Yet as jobs have become harder to get, so has welfare: as of 2006, 44 states cut off anyone with a household income totaling 75 percent of the poverty level — then limited to $1,383 a month for a family of three — according to an analysis by Ms. Albelda.
“We have a work-based safety net without any work,” said Timothy M. Smeeding, director of the Institute for Research on Poverty at the University of Wisconsin, Madison. “People with more education and skills will probably figure something out once the economy picks up. It’s the ones with less education and skills: that’s the new poor.”
Here in Orange County, the expanse of suburbia stretching south from Los Angeles, long-term unemployment reaches even those who once had six-figure salaries. A center of the national mortgage industry, the area prospered in the real estate boom and suffered with the bust.
Until she was laid off two years ago, Janine Booth, 41, brought home roughly $10,000 a month in commissions from her job selling electronics to retailers. A single mother of three, she has been living lately on $2,000 a month in child support and about $450 a week in unemployment insurance — a stream of checks that ran out last week.
For Ms. Booth, work has been a constant since her teenage years, when she cleaned houses under pressure from her mother to earn pocket money. Today, Ms. Booth pays her $1,500 monthly mortgage with help from her mother, who is herself living off savings after being laid off.
“I don’t want to take money from her,” Ms. Booth said. “I just want to find a job.”
Ms. Booth, with a résumé full of well-paid sales jobs, seems the sort of person who would have little difficulty getting work. Yet two years of looking have yielded little but anxiety.
She sends out dozens of résumés a week and rarely hears back. She responds to online ads, only to learn they are seeking operators for telephone sex lines or people willing to send mysterious packages from their homes.
She spends weekdays in a classroom in Anaheim, in a state-financed training program that is supposed to land her a job in medical administration. Even if she does find a job, she will be lucky if it pays $15 an hour.
“What is going to happen?” she asked plaintively. “I worry about my kids. I just don’t want them to think I’m a failure.”
On a recent weekend, she was running errands with her 18-year-old son when they stopped at an A.T.M. and he saw her checking account balance: $50.
“He says, ‘Is that all you have?’ ” she recalled. “ ‘Are we going to be O.K.?’ ”
Yes, she replied — and not only for his benefit.
“I have to keep telling myself it’s going to be O.K.,” she said. “Otherwise, I’d go into a deep depression.”
Last week, she made up fliers advertising her eagerness to clean houses — the same activity that provided her with spending money in high school, and now the only way she sees fit to provide for her kids. She plans to place the fliers on porches in some other neighborhood.
“I don’t want to clean my neighbors’ houses,” she said. “I know I’m going to come out of this. There’s no way I’m going to be homeless and poverty-stricken. But I am scared. I have a lot of sleepless nights.”
For the Eisens, poverty is already here. In the two years Ms. Eisen has been without work, they have exhausted their savings of about $24,000. Their credit card balances have grown to $15,000.
“I don’t know how we’re still indoors,” she said.
Her 1994 Dodge Caravan broke down in January, leaving her to ask for rides to an employment center.
She does not have the money to move to a cheaper apartment.
“You have to have money for first and last month’s rent, and to open utility accounts,” she said.
What she has is personality and presence — two traits that used to seem enough. She narrates her life in a stream of self-deprecating wisecracks, her punch lines tinged with desperation.
“See that,” she said, spotting a man dressed as the Statue of Liberty. Standing on a sidewalk, he waved at passing cars with a sign advertising a tax preparation business. “That will be me next week. Do you think this guy ever thought he’d be doing this?”
And yet, she would gladly do this. She would do nearly anything.
“There are no bad jobs now,” she says. “Any job is a good job.”
She has applied everywhere she can think of — at offices, at gas stations. Nothing.
“I’m being seen as a person who is no longer viable,” she said. “I’m chalking it up to my age and my weight. Blame it on your most prominent insecurity.”
Two Incomes, Then None
Ms. Eisen grew up poor, in Flatbush in Brooklyn. Her father was in maintenance. Her mother worked part time at a company that made window blinds.
She married Jeff when she was 19, and they soon moved to California, where he had grown up. He worked in sales for a chemical company. They rented an apartment in Buena Park, a growing spread of houses filling out former orange groves. She stayed home and took care of their daughter.
“I never asked him how much he earned,” Ms. Eisen said. “I was of the mentality that the husband took care of everything. But we never wanted.”
By the early 1980s, gas and rent strained their finances. So she took a job as a quality assurance clerk at a factory that made aircraft parts. It paid $13.50 an hour and had health insurance.
When the company moved to Mexico in the early 1990s, Ms. Eisen quickly found a job at a travel agency. When online booking killed that business, she got the job at the beauty salon equipment company. It paid $13.25 an hour, with an annual bonus — enough for presents under the Christmas tree.
But six years ago, her husband took a fall at work and then succumbed to various ailments — diabetes, liver disease, high blood pressure — leaving him confined to the couch. Not until 2008 did he secure his disability check.
And now they find themselves in this desert of joblessness, her paycheck replaced by a $702 unemployment check every other week. She received 14 weeks of benefits after she lost her job, and then a seven-week extension.
For most of October through December 2008, she received nothing, as she waited for another extension. The checks came again, then ran out in September 2009. They were restored by an extension right before Christmas.
Their daughter has back problems and is living on disability checks, making the church their ultimate safety net.
“I never thought I’d be in the position where I had to go to a food bank,” Ms. Eisen said. But there she is, standing in the parking lot of the Calvary Chapel church, chatting with a half-dozen women, all waiting to enter the Bread of Life Food Pantry.
When her name is called, she steps into a windowless alcove, where a smiling woman hands her three bags of groceries: carrots, potatoes, bread, cheese and a hunk of frozen meat.
“Haven’t we got a lot to be thankful for?” Ms. Eisen asks.
For one thing, no pinto beans.
“I’ve got 10 bags of pinto beans,” she says. “And I have no clue how to cook a pinto bean.”
Local job listings are just as mysterious. On a bulletin board at the county-financed ProPath Business and Career Services Center, many are written in jargon hinting of accounting or computers.
“Nothing I’m qualified for,” Ms. Eisen says. “When you can’t define what it is, that’s a pretty good indication.”
Her counselor has a couple of possibilities — a cashier at a supermarket and a night desk job at a motel.
“I’ll e-mail them,” Ms. Eisen promises. “I’ll tell them what a shining example of humanity I am.”

U.S. to embed agents in Mexican law enforcement units battling cartels in Juarez

CIUDAD JUAREZ, MEXICO -- For the first time, U.S. officials plan to embed American intelligence agents in Mexican law enforcement units to help pursue drug cartel leaders and their hit men operating in the most violent city in Mexico, according to U.S. and Mexican officials.

The increasingly close partnership between the two countries, born of frustration over the exploding death toll in Ciudad Juarez, would place U.S. agents and analysts in a Mexican command center in this border city to share drug intelligence gathered from informants and intercepted communications.

Until recently, U.S. law enforcement agencies have been reluctant to share sensitive intelligence with their Mexican counterparts for fear they were either corrupt or incompetent. And U.S. agents have been wary of operating inside Mexican command centers for fear they would be targeted for execution in the sensational violence and lawlessness in Ciudad Juarez that left more than 2,600 people dead last year.

But those attitudes are changing amid strong support from Washington for President Felipe Calderón's war against the cartels, including a $1.4 billion aid package. The Obama administration views spiking drug violence in Mexico as a direct threat to U.S. security and has taken unprecedented steps toward on-the-ground cooperation with Mexican authorities. It is seeking an additional $310 million for drug enforcement aid for Mexico in its 2011 budget.

Under the new arrangement, U.S. law enforcement officers, most likely from an agency such as the Drug Enforcement Administration, would work alongside recent graduates of the new Mexican federal police academy who were trained by FBI and DEA advisers as part of the U.S. aid package.

In another departure from past practice, vetted federal police agents from Mexico might gain greater access to drug intelligence centers in the United States.

"The idea is to take our full technological and human capabilities and put them at the service of a willing partner to address what is a crisis situation," said a senior U.S. official in Mexico who spoke on the condition of anonymity because a bilateral meeting on the arrangement -- which does not require congressional approval -- is scheduled this week.

The actions come as Calderón faces mounting criticism for his failure to demonstrate progress in the battle for Ciudad Juarez, a gritty industrial town across the border from El Paso that has become one of the most dangerous places in the world despite the presence of 10,000 soldiers and police officers.

Although Mexican authorities have for months said they were working on a new strategy to confront the violence in Ciudad Juarez, they have little to show for their efforts.

The federal attorney general's office in Ciudad Juarez has prosecuted one case of organized crime. Of the 2,670 homicides recorded here last year, state prosecutors have mounted 37 murder cases.

"Few of these will ever go to trial," said Jorge González, head of the state public defender's office in Juarez.

As an example, González said that although state prosecutors trumpeted the August arrest of four men they said were assassins responsible for 211 killings, no formal charges have been brought against the suspects, who allegedly work for La Linea, a group composed of former police now employed by the Juarez drug cartel.

"It's all for show," González said, "all for the cameras."

'A horrible error'

A massacre of 15 people last month, including 10 teenagers attending a birthday celebration, may have been a watershed event -- at least politically.

After blocking off the streets, more than a dozen gunmen burst into the party and went on a rampage. Several of the dead were well-known football players at a local high school. After the massacre, Calderón enraged residents by suggesting that the young victims may have been involved with drugs and were possibly killed by rival gangs.

Calderón and his supporters point out that most of the more than 17,000 people killed in the country's drug war have been narcotics traffickers and other criminals -- though the Security Commission of the Mexican Senate reports that among the dead are 620 women, 1,500 police officers and 87 soldiers.

"It was a horrible error and an insult to these kids and their families, because it was absolutely clear that the vast majority of them were just kids in high school and junior high, athletes, what we would call 'normal kids,' " said José Luis Piñeyro, a military analyst in Mexico City who frequently writes about the drug war.

Though Ciudad Juarez is the front line of his fight against the cartels, Calderón has been an infrequent visitor -- what one U.S. official called "an absentee president." But after the students were killed, Calderón traveled to Juarez twice in less than a week.

At an appearance during his first visit, as he sat beside his wife on a low stage, the mother of two slain teenagers confronted him directly. "I bet that if they had killed your children, you would have looked under every rock to find the killers. But I don't have the resources that you do," Luz María Dávila told Calderón.

A city withering away

Since his inauguration three years ago, Calderón has pursued a U.S.-backed strategy of relying on the Mexican military to confront the cartels fighting for dominance in the billion-dollar corridors to the U.S. drug market. The Mexican troops, who lack law enforcement training or investigative abilities, have made record numbers of arrests, but few of the detained have gone to trial. Instead, the military has been accused of human rights abuses -- coerced confessions, illegal detention, unlawful searches.

"This is an enormous mess. It is now starting to hurt Calderón politically. He cannot point to any success. And he is running out of time," said Jorge Castañeda, a former Mexican foreign minister and now a professor at New York University.

According to U.S. and Mexican officials, the municipal police cannot be trusted, nor can they operate on their own. One U.S. official said a local police chief was caught briefing his cartel bosses via cellphone immediately after planning sessions.

Ciudad Juarez is withering away from violence. The local newspaper El Diario reported last week that more than 2,500 small grocery stores have been shuttered because of extortion attempts or because the city is emptying of residents. The Mexican social security administration says 75,000 people have lost their jobs since 2007, according to a report in the El Paso Times. Analysts estimate that as many as 200,000 people may have fled the city for other parts of Mexico or the United States.

In his visits to Ciudad Juarez, Calderón and his cabinet promised the equivalent of a social surge -- a rapid injection of $50 million to build schools, parks, day-care centers and a sports field to be named after the student victims.

U.S. officials in Mexico say the new Calderón plan, dubbed "We Are All Juarez," will pull the military away from its controversial patrols through the city, replacing troops with federal police supported by several hundred of the newly U.S.-trained investigators from the police academy.

But it is still uncertain what new strategy -- if any -- will be employed. Calderón has promised to keep the military in the fight in Juarez, and the spokesman for the operation, Enrique Torres, said in an interview that 1,200 troops will continue to patrol the city with municipal police.

Calderón has promised results in 100 days.

Judge tosses sanctuary suit in S.F. killings

(02-23) 17:44 PST SAN FRANCISCO -- The family of a father and two sons who were shot dead on a San Francisco street in 2008 can't hold the city responsible for failing to turn their alleged killer over to immigration authorities after earlier arrests, a judge has ruled.
The city isn't legally to blame for any crimes Edwin Ramos, a suspected illegal immigrant from El Salvador, committed after his release for the offenses he committed as a juvenile, Judge Charlotte Woolard of San Francisco Superior Court said Monday.
Cities "generally are not liable for failing to protect individuals against crime," Woolard said.
She dismissed a damage suit by the widow and daughter of Tony Bologna, 48, who was shot to death in his car near the family's home in the Excelsior district in June 2008. His sons Michael Bologna, 20, and Matthew Bologna, 16, were also killed.
Their brother, who survived the attack, identified Ramos, then 21, as the man who fired the fatal shots from a passing car. Police said the gunman may have mistaken the younger Bolognas for gang members.
Ramos told police that he had been driving the car but that another man had fired the shots. He has pleaded not guilty to three counts of murder and faces life in prison without parole if convicted.
The Bologna family's lawyer, Matthew Davis, said they would appeal Woolard's ruling. Davis said he agrees that a city usually can't be held responsible for failing to prevent a crime, but he contended that the shield of immunity shouldn't protect San Francisco because by failing to turn over Ramos to immigration authorities, it was "flat-out violating the law."
Matt Dorsey, spokesman for City Attorney Dennis Herrera, said Woolard had relied on well-established law in deciding that San Francisco was not liable for Ramos' actions.
RAMOS - MS13 GANG SLUG
Ramos, whom prosecutors describe as a member of the MS-13 gang, was arrested as a juvenile for an assault in October 2003 and an attempted purse-snatching in 2004. Juvenile courts sent him to a shelter after the first incident and to the city-run Log Cabin Ranch in the Peninsula hills after the second.

Case records don't show whether police or juvenile courts suspected that Ramos had entered the United States illegally. But under the city's sanctuary policy, as juvenile authorities then interpreted it, they would not have passed along that information to federal immigration officials.

Mayor Gavin Newsom reversed that practice in 2008 and ordered city employees to report suspected illegal immigrant youths to federal authorities after felony arrests. City supervisors passed an ordinance over Newsom's veto that delayed reporting until a youth is found to have committed a felony, but the mayor is refusing to enforce it, saying it violates federal law.
After Ramos' release, federal authorities learned of his immigration status but did not take him into custody. The family's lawsuit contended, however, that the city was responsible for the shootings because its policy had allowed Ramos to go free.
In her ruling, Woolard said San Francisco had no duty to protect the Bolognas or anyone else from Ramos unless city officials had information that he posed a specific danger to them. There was no such evidence in this case, she said.
Davis also argued that San Francisco had violated a federal law prohibiting local authorities from interfering in immigration enforcement and should be held responsible for any resulting harm. The judge, however, questioned whether the law applied to the city's actions.
She said the law couldn't be a basis for finding the city liable because it was intended to improve immigration controls, not to prevent crime.

S.F. school board votes to send pink out slips

(02-23) 23:09 PST SAN FRANCISCO -- Nearly 900 San Francisco teachers and administrators will see a dreaded pink slip in their mailboxes next month, a mass mailing made necessary by the district's need to brace for a $113 million shortfall over the next two years.
The school board approved the layoff notices Tuesday night, with district officials saying they hoped to rescind many of the mas soon as possible, but given the dire budget situation ,the cuts to programs and staff are bound to be massive.
The layoff notices must be sent to teachers by the state's March 15 deadline notifying them that they might not have a job next year. The notices could be rescinded in the spring or summer when the district has a clearer understanding of it budget situation.
"I do not want to sugar coat this for anyone out there," said Superintendent Carlos Garcia. "The reality is when everything is said and done there will be some layoffs this year."
In the meantime,318 teachers, 98 principals and assistant principals, 10 librarians and all other district employees who receive a layoff notice won't know whether they'll be back in August. Teachers with the lowest seniority are at greatest risk.
At El Dorado Elementary, 12 of the 15 teachers are within their first three years teaching in the district and likely will get a pink slip, said Principal Tai Schoeman.
"It's devastating," he said, adding that not all teachers want to work with at-risk students, but his do. "It's a great place to work because everyone looks out for one another. It took me a long time to get to that place."
District officials hope other cost-saving measures - increases in class sizes, furloughs, early retirements and cuts to salaries and benefits - will reduce the number of layoffs. Some of those efforts require union approval.
For now, the district is operating under a worst-case budget scenario, accounting for the huge number of layoff notices being sent out this week. The layoff list includes full- and part-time workers representing 800 full-time jobs. On Tuesday, parents railed against the layoffs and state funding of education.
"It's like a crime scene," said Crystal Brown, a parent at Sherman Elementary. "You can't just sit back anymore."
Brown, with six other PTA moms at Sherman, have organized a town hall meeting for Thursday at Marina Middle School to address school funding issues.
What started as a small gathering has ballooned into a massive meeting with 1,000 people expected, including state and local elected officials.
Also Tuesday, the board approved a name change for the School of the Arts to honor renowned artist Ruth Asawa, a key player in creation of the public arts high school in 1981.
Asawa, whose art hangs in the DeYoung Museum and has been shown in museums around the world, was dedicated to keeping art in schools despite endless cuts to programs across California in recent years.
Asawa for years resisted efforts to rename the school after her because she still considered it a work in progress without a permanent home. With her health declining, she finally consented a couple of months ago, said board member Jill Wynns, who spearheaded the renaming effort.
The school will now be called the Ruth Asawa San Francisco School of the Arts.

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Illness Hinders Plans to Close Immigration JailBy NINA BERNSTEIN
When Immigration and Customs Enforcement officials announced last month that they would close New York City’s only immigration jail and relocate its roughly 300 detainees to New Jersey, they described the step as part of a larger overhaul to improve health care and cost-effectiveness in the nation’s detention system.

But with only three days to go before the official end of detention operations at the jail, the Varick Federal Detention Facility in Greenwich Village, on Friday, officials have found that the detainees hardest to relocate are those with serious medical problems.

And each day, dozens of noncitizen New Yorkers — some with acute or chronic ailments — are still entering Varick, which immigration officials say they will keep using only as a processing hub for about 11,000 men a year, to be held no more than 12 hours.

For years the immigration jail, on the fourth floor of a federal office building at Varick and Houston Streets, was supposed to be a brief holding place for New York detainees. But it ended up keeping hundreds of detainees for months, especially those with medical or mental problems who were often denied admission by county jails in New Jersey where immigration authorities rent cells.

Immigrant advocates predict the same problem will recur. “Whether they plan on it or not, detainees are going to be held longer than intended at Varick,” said Udi Ofer, advocacy director of the New York Civil Liberties Union, who analyzed hundreds of detainee grievances obtained under the Freedom of Information Act, in a report to be released Wednesday.

“Moving detainees from New York to New Jersey is not going to fix the problem of inadequate care for immigration detainees,” Mr. Ofer added, echoing other advocates who question whether the government should be detaining so many in the first place. “The absence of legally enforceable standards leads to situations where detainees are being mistreated, whether they’re being held for a day, a month or a year.”

Last week, as federal officials took a reporter on a rare tour of the jail, past the crowded holding cells into locked dorms and disciplinary cells that double as “medical holds,” one of the longtime detainees waiting to learn his fate was Adler Michel, 52, a legal resident from Haiti with diabetes, high blood pressure and a swollen jaw.

Mr. Michel, a Brooklyn barber with two drug convictions but no record of violence, has spent more than 20 months at Varick while battling deportation. Officials said one reason he stayed was that at least one New Jersey jail had refused to accept him because of medical concerns. He is ineligible for bond under laws that require detention for immigrants who have ever been convicted of misdemeanor drug possession, or any of a long list of other offenses.

“Obviously, his medical needs must and will be addressed by us while he is in our custody,” said Brian P. Hale, a spokesman for the immigration enforcement agency. The 100 detainees remaining on Tuesday were expected to be reduced to 70 by the end of the day, he added.

Beth Gibson, senior counsel to the agency’s chief, who joined Mr. Hale on the tour of Varick, said opening the jail to a reporter underscored the Obama administration’s commitment to transparency and reform. Plans she cited include streamlining cumbersome paperwork requirements that delay needed care.

“We didn’t get where it is overnight,” Ms. Gibson said.

But immigrant advocacy groups see the handling of Varick detainees as an illustration of the unfairness and waste in the $1.7 billion detention system.

A coalition of 16 legal and advocacy organizations offered this month to collaborate on a case-by-case review to identify detainees eligible for release, parole, or alternatives to detention like electronic monitoring, which costs about $14 a day, instead of Varick’s $253 or the $111 at the Hudson County Correctional Center, where many detainees are being transferred.

But last week, their request was rejected by federal officials, who said they lacked the resources to conduct such a review before the transfers.

At most of the New Jersey jails, health care is provided by a company with a record of medical cost-cutting that has sometimes proved lethal. Federal officials pledged that a government physician at Varick, Dr. Peter D’Orazio, would oversee the care of the relocated New York detainees and screen those entering the jail.

But that does not reassure the Civil Liberties Union lawyers, who said that Dr. D’Orazio was no help when they tried to get proper care for a detainee suffering from infected teeth and gastrointestinal ailments.

“As I write this, I am in so much pain that I want to hit my head against the wall and cry,” the detainee, then 23, wrote last July, in one of more than 210 grievances filed by Varick detainees between August 2008 and August 2009. About 30 percent of the complaints cited medical neglect.

A medical screening record notes that the detainee had a tooth abscess when he entered the jail in October 2008. But despite his pleas to see a dentist, it went untreated for 10 months and spread to seven teeth, Mr. Ofer said, even as the detainee was put on a liquid diet because he could no longer chew.

Only after Mr. Ofer intervened did the man get to see a dentist, who offered extraction, records show. The detainee, who remains at Varick, instead wants to save the teeth with root canals at his own expense, Mr. Ofer said. The government has refused, citing liability issues.

Asked about the case, Dr. D’Orazio first denied that the detainee had an abscessed tooth, then said: “We addressed his issue. Now it’s up to him to seek the care.”

Most grievances cannot be checked and outcomes are not known because detainee names were redacted by the government under privacy laws. But one described an attempt to deport a detainee with prostate cancer two days after he had requested a doctor’s appointment.

The detainee, a 47-year-old Russian, wrote in November 2008 of being locked in a van at Kennedy International Airport for hours in acute pain as guards refused to let him go to the bathroom. He was eventually returned to Varick and catheterized, he wrote.

Records confirm that he had been found to have cancer at Beth Israel Medical Center before his detention and that he had been advised to get immediate treatment. But on Dec. 9, 2008, the detainee, still waiting for a medical appointment, wrote in a grievance, “Will it be after my death?”

An official’s handwritten note adds that the detainee was deported 12 days later.
