On Monday night, the Senate voted to move forward with debate on Senate Majority Leader Harry Reid’s (D-NV) jobs bill, the Hiring Incentives to Restore Employment (HIRE) Act (S.AMDT.3310 to H.R.2847). The HIRE Act has two major tax provisions: (1) an exemption from payroll taxes for employers who hire new employees in 2010 and (2) a $1,000 tax credit for employers who keep those employees for at least 52 weeks. However, the bill does not require that these new workers be American workers or that employers use E-Verify to confirm that the workers hired are work authorized. (See FAIR’s Legislative Update)
To make matters worse, Senate Majority Leader Reid intends to block all amendments to the HIRE Act and to hold a vote on final passage tonight!

California's dire and ongoing budget predicament is raising a tough - and touchy - question about the state's finances, one that some at the Capitol do not want discussed: Is California bankrupt?
Leaders and would-be leaders from both major parties have raised the b-word in the past weeks, and the Golden State is frequently labeled as bankrupt by people nationwide.
Federal law prohibits states from declaring bankruptcy and without a legal framework, assertions about California's solvency are left to interpretation. But persistent multibillion-dollar budget deficits, cash crises, tens of billions of dollars in debt and other obligations have blurred the legal distinction.
"California is deeply in debt. You could say that it's bankrupt," Attorney General - and presumptive Democratic gubernatorial candidate - Jerry Brown told a group of young Democrats earlier this month.
Republican U.S. Senate hopeful and former Hewlett Packard CEO Carly Fiorina raised the specter of bankruptcy in a discussion with Southern California business owners. And Republican Assemblywoman and retired banker Diane Harkey of Dana Point (Orange County) said the state is "literally bankrupt."
Protecting state's reputation
She compared the state's situation to a family with a mortgaged house, maxed out credit cards and zero savings. She said her outspokenness on the topic at public meetings and other forums has caused some at the Capitol to tell her she is apocalyptic, and she said she has been asked to quiet down.
"It would be nice if we could hide our problems like nobody knew about them, but the bond market is watching. It's not a secret," Harkey said, adding later: "I'm scared. I want to get the state fixed."
Statements like Harkey's could actually hurt the state, said Tom Dresslar, spokesman for Treasurer Bill Lockyer.
"You might score some political points by saying the state is bankrupt, but you're hurting taxpayers when you do that. We are not basically bankrupt," Dresslar said. "When you have that kind of talk out there and it makes it into the papers, it poisons the market when you go to sell bonds."
He noted a recent report done by the Fitch credit rating agency that said if public officials actively discuss bankruptcy, "Fitch will assess whether the entity's current rating should be maintained." A lower rating makes it more expensive to borrow.
Although there is no legal definition of bankruptcy for a state, smaller municipalities are able to declare bankruptcy, like the city of Vallejo two years ago and Orange County in 1994. The definitions differ depending on the type of bankruptcy, but generally, municipal bankruptcies occur when a government is unable to pay its bills in the immediate future and/or through the next fiscal year, according to bankruptcy experts.
That won't happen in California, state financial leaders say, because the lowest the state could fall financially would be to miss a debt payment. That hasn't happened since the Great Depression, but California owes $8.8 billion in short-term loans that have to be paid off by June and almost $120 billion in outstanding bonds and interest that will be paid over decades.
Over the next 16 months, the state has a $20 billion deficit in the general fund budget. That's the equivalent of nearly a quarter of the current spending plan of $84.5 billion. Much of that spending is locked in because of voter initiatives and federal mandates, limiting options for lawmakers. The deficit this year is more than the state spends on higher education and prisons combined.
The state's pension fund, CalPERS, has $16.3 billion more in liabilities than assets at the latest calculation, although that number fluctuates with the system's investment portfolio. Adding to that, a state report released this month calculated that California also faces a $51.8 billion bill - in 2009 dollars - for the health and dental benefits of state retirees and future retirees.
State Controller John Chiang, who made that report, said, "No, we are not functionally bankrupt." He said California would reach its breaking point if there were court intervention due to debt default.
"That's our equivalent of going into bankruptcy," said Chiang, adding that, "I don't want that to be put in the real, serious realm of discussion." The state Constitution mandates that debt service has the second highest priority for payment, after only education, and the state continuously receives tax revenues.
Lacking cash to pay debts
But while California has had steady cash to make those payments, it has not always had the cash on hand for its other obligations. Last year, the state issued 450,000 IOUs to vendors and to residents awaiting state income tax returns and halted construction on thousands of infrastructure projects. The state has the lowest credit rating of any state in the nation, although it still is above junk-bond status.
If the state falls to junk status, some investors would be unable to buy state bonds, making it even more difficult for the state to borrow money and infuse cash into its coffers. Either way, it now costs the state more to borrow the money it needs to function.
Chiang also published a cash-flow forecast this month predicting that over the next 10 months, even if lawmakers adopt Gov. Arnold Schwarzenegger's plan to balance the budget, California will have to borrow multiple billions to pay its bills later in the year. Cash-flow borrowing is common and has been necessary for the state for more than two decades due to the cycle of when bills are due and when revenue comes in, according to the controller's office.
Another cash shortage this summer could mean more IOUs and other delayed payments, but Chiang and others are making strong assurances the state will have no trouble paying its most necessary bills.
"Going back to the Great Depression, California has never missed a payment to a debt holder or a bond holder and we will continue to move heaven and earth to make sure that never happens," said H.D. Palmer, spokesman for the state Department of Finance.
The state's finances are a bigger picture than just the infamously indebted $84.5 billion general fund. Including bond funds and special funds that by law have to be spent for specific purposes, the budget is $119 billion. Those funds are continuously depleted by lawmakers in an effort to fix the general fund, and they have to be paid back eventually.
On the asset side of the balance sheet, the state also owns billions of dollars worth of property and structures, scenic parks and other holdings.
California's overall balance sheet has $34 billion more in net assets than net liabilities, according to a controller's report from 2008, the most recent published. The report also showed the ratio between assets and liabilities declined 25 percent from the year before.
Jack Ayer, a UC Davis professor of law emeritus and a former federal bankruptcy judge, said a fair measure of an insolvent state would be if its assets are worth less than liabilities and if it could not pay all of its bills. The real-world outcome of that would be banks no longer lending money to the state, he said.
Considering state's assets
"The banks are happy to keep lending - they don't want to stop - but if they aren't going to get paid back, they are going to stop," Ayer said. And while the state does have assets, a fire truck or a courthouse doesn't have much value to any entity other than the government, he said.
That's a key distinction for states as opposed to other entities when considering assets, said Jason Sisney, director of state administration at the legislative analyst's office, who said the vast majority of the state's assets aren't able to quickly be turned into cash at any given time.
"State governments, on a day-to-day basis, don't operate thinking about any of these things," he said, adding that there is "no real way to pretend there is cash when there's not."
Still, he said, it is "nearly impossible" for the state to miss a debt payment. States are sovereign entities with the power to tax, change spending through law and issue IOUs.
The treasurer plans to sell $10 billion to $14 billion in bonds this year, with the first sale of $2 billion scheduled for the first week in March.

Arizona, Virginia Address Illegal Immigration as Feds Continue to Look the Other Way
With the federal government’s persistent refusal to enforce immigration laws, state legislatures across the country continue to address the issue of illegal immigration on their own. Last week, the Virginia House of Delegates and the Arizona State Senate both passed enforcement-oriented legislation.
On Monday, February 15, the Arizona State Senate passed Senate Bill (SB) 1070 by a vote of 17 to 13. (Vote Results). Entitled the “Support Our Law Enforcement and Safe Neighborhoods Act,” SB 1070 would prohibit Arizona police departments from adopting sanctuary policies that prevent officers from asking individuals about their immigration status. SB 1070 would also establish a new state trespassing statute that would make it illegal for any person to be present on any public or private land in Arizona in violation of federal immigration law. (SB 1070; For more on SB 1070, see East Valley Tribune, February 15, 2010). In addition, the Arizona Senate passed another bill, SB 1027, which would require the state’s Department of Public Safety to “seek grants to implement a one-year pilot program that would use seismic sensors to monitor rural airport runways and other rural areas of [Arizona] where illegal drug traffic and illegal alien traffic or human smuggling are likely to occur.” (SB 1027). Both bills have been sent to the Arizona House for further action. (See Bill Status Overviews for SB 1070 and SB 1027). The legislative prospects for the bills are unclear at this point. While SB 1070 has drawn support from the Phoenix Law Enforcement Association and the Arizona Police Association, a similar bill stalled in the Arizona House during the last legislative session after passing through the Senate. One day after the action in the Arizona Senate, the Virginia House of Delegates overwhelmingly approved House Bill (HB) 737 by a vote of 82 to 13. (Vote Results). Originally, HB 737 would have required all state agencies, local governments, public contractors, and employers with 15 or more employees to enroll in E-Verify. (HB 737 – Text as Introduced). However, after intense lobbying by big business special interest groups, the House of Delegates passed a pared-down version of the legislation that would require only state agencies and local governments to enroll in E-Verify. (HB 737 – Text as Passed by House). Under the bill, government agencies would be required to enroll in E-Verify before December 1, 2010 and subsequently use E-Verify for each newly hired employee who is to perform work within the state of Virginia. (Id.). The bill has now moved to the Virginia Senate, where it has been referred to the Senate Committee on Commerce and Labor. (Bill Tracking). Obama soft on illegals enforcement
Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.
The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

As Border Crime Escalates, U.S. and Mexico Agree to Join Forces
The United States and Mexico are joining forces to crack down on drug smuggling and illegal immigration across their borders. Last week, Department of Homeland Security (DHS) Secretary Janet Napolitano announced a new partnership between U.S. Border Patrol and Mexico’s federal police aimed at securing the U.S.-Mexico border. (DHS Press Release, February 18, 2010). Napolitano and her Mexican counterpart, Genaro García Luna, signed a declaration on joint efforts to secure the border and share information about transnational threats while streamlining legitimate travel and trade. Id. “The success of our efforts to crack down on criminal organizations and others who threaten the safety of our citizens requires close collaboration between the United States and Mexico,” said Secretary Napolitano. Id. “This declaration will allow us to better protect both nations against violent drug cartels and transnational smuggling of drugs, cash and firearms while facilitating legitimate travel and trade.” Id.
The declaration outlines principles to enhance border security, including:
• Intelligence-driven operations with precise, targeted outcomes;
• Cooperation focused on increasing bilateral situational awareness of threats;
• Operations designed to deny access by criminal organizations between ports of entry;
• Enforcement that effectively prevents criminals from exploiting border entry points;
• Sufficient personnel, infrastructure and technology needed to sustain bilateral efforts.

The effort faces substantial hurdles, including violent drug mafias, long-standing Mexican reluctance to interfere with illegal immigration into the United States, and a legacy of corruption that has plagued enforcement efforts in Mexico. (Los Angeles Times, February 17, 2010). "There's so much potential for corruption. It could be destined for failure," said Jennifer Allen, executive director of the Border Action Network, a migrant advocate group in Arizona. Id. Allen also pointed out that law enforcement in Mexico has been unable compete with the money or the power of the drug trafficking networks. Id.
Mexican officers, who undergo U.S. background checks, will be trained by Border Patrol in close-quarters firearms techniques and medical rescue skills, as well as ways to detect contraband concealed in vehicles. Id. Joint U.S.-Mexican operations between Mexican federal police and American agents have included daily communication, responding to security threats, disrupting smugglers' hilltop lookouts, and breaking up rock-throwing gangs who often clash with U.S. agents. The Mexican forces have also developed new southern barriers to smuggling drugs and people. "The coordination will make our pursuits more flexible so we can stop criminals from ducking back and forth across the border," said Mexican federal police Cmdr. Armando Trevino, adding that his agency "is most ready to seal the border to put an end to this organized crime." Id. Despite this commitment to aggressively pursue smugglers, Trevino and his officers have no intention to interfere with Mexicans who are illegally crossing the border absent evidence of other criminal activity. Id.

Just last week, U.S. Border Patrol in Arizona seized more than 1,500 pounds of marijuana, worth an estimated $1.25 million. (KVOA News, February 18, 2010). The agents discovered the marijuana in a stolen vehicle that had been abandoned in the desert. Id. This latest seizure continues another record-breaking year for marijuana busts in the Border Patrol’s Tucson Sector. (Arizona Daily Star, February 18, 2010). According to the most recent statistics, agents had seized 350,000 pounds of marijuana through the first four months of fiscal year 2010, up from 341,000 the same time the year before. Id. Furthermore, according to the annual report from the Director of National Intelligence, approximately 90% of the cocaine that reaches the U.S. from South America comes through Mexico. (February 2, 2010).
A major goal of the U.S.-Mexico partnership is to help Mexico fight violent drug cartels, which are often better funded and more heavily armed than Mexican police. Mexico has been unable to deal with the drug cartels that threaten its security, as evidenced by the marked increase in violent crimes, including murders and kidnappings in the midst of gang warfare. Earlier this month, 16 teenagers were violently gunned down at a party in the Mexican border city of Ciudad Juarez across the Rio Grande from El Paso, Texas. (The Wall Street Journal, January 31, 2010). And in the first 10 days of 2010, a total of 283 people are estimated to have died in drug-related violence in Mexico, which is more than double the number during the same period in 2009. (The Atlantic, February 10, 2010). It is apparent that the threat from drug mafias is now extending into the U.S. across our southern border. Last year, in a hearing before the Senate Homeland Security and Governmental Affairs Committee, Secretary Napolitano expressed her commitment to addressing the threat of cartel violence in Mexico as a top homeland security priority for the United States. (See Transcript of Napolitano’s Testimony, March 25, 2009). She told the panel of senators that “the cartels have fingertips that reach throughout the United States.” Id.
Calderón, elected in 2006, has essentially declared war on the drug cartels. As the influence and intimidation of the cartels on local governments has increased, the Mexican president has attempted to fight the war with national forces and agencies. But it is increasingly apparent that the corruption has moved to those national agencies, as reports of abuses by the national drug-fighting forces escalate. Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.
The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

State Trooper Prevails Against ACLU and Illegal Aliens in Bogus Lawsuit
On February 4, the United States Court of Appeals for the First Circuit dismissed a lawsuit that had been filed by the ACLU against a Rhode Island state trooper who contacted Immigration and Customs Enforcement (ICE) upon discovering that a group of foreign nationals he encountered were illegal aliens. In dismissing the suit, the First Circuit held that the ACLU – who had sued the state trooper and the state of Rhode Island on behalf of the illegal aliens – could not prevail on the multiple causes of action they filed against the trooper because he had acted “reasonably” throughout the entire encounter. (Opinion, February 4, 2010).
The lawsuit stemmed from a July 11, 2006 traffic stop, in which a Rhode Island state trooper pulled over a 15-passenger van for failure to signal when changing lanes. The driver produced a valid license, registration, and insurance, and stated that he was taking the other 14 passengers in the van to work. The trooper asked the passengers for identification. One of the passengers produced a gym membership card, one offered a non-driver ID card, and two others presented cards issued by the Guatemalan consulate. Though the trooper had difficulty communicating with the individuals because they spoke very little English, he was eventually able to determine that none of the passengers had legitimate identification documents. The aliens ultimately admitted that they were present in the United States illegally. The trooper then conducted a standard background check on the driver and contacted ICE. Three minutes later, ICE called back and asked Chabot to escort the van to ICE’s Providence, Rhode Island field office so that they could address the matter further. Upon arriving at the field office, all 14 passengers were arrested for immigration violations. (Id.).
Six months later, the ACLU sued the state trooper on behalf of the illegal aliens. In January 2007, the 14 passengers filed a complaint in federal court alleging that the trooper had conducted an illegal search and seizure in violation of federal civil rights laws, the Fourth and Fourteenth Amendments of the United States Constitution, and the Rhode Island State Constitution. Specifically, the illegal aliens claimed that the trooper illegally prolonged an otherwise lawful traffic stop when he questioned the aliens as to their immigration status and then took action when he learned they were in the country illegally. The trooper contacted ICE and escorted the aliens to the Providence, Rhode Island ICE field office. The complaint also alleged that the trooper had discriminated against the passengers in violation of both state and federal laws, and further claimed that he had acted negligently. On December 30, 2008, a federal judge dismissed the suit on all grounds, ruling that the trooper had reasonable suspicion to suspect immigration violations and to transport the van’s passengers to ICE, prompting an appeal by the ACLU and the illegal aliens to the First Circuit. (Id.).
At this point in the litigation, FAIR’s litigation arm – the Immigration Reform Law Institute (IRLI) – got involved. IRLI attorneys filed an amicus curiae (“friend of the court”) brief arguing that (1) inquiry into the immigration status of vehicle occupants during a lawful traffic stop does not constitute an unreasonable search and seizure under the Fourth Amendment and (2) the trooper had immediate reasonable suspicion to “shift the focus” of the stop from a traffic violation to violations of federal immigration law upon failure of the passengers to produce valid identification. (IRLI Bulletin, July 2009).
On February 4, the First Circuit upheld the District Court’s decision to dismiss the case. The court observed that, before he called ICE, the trooper already knew that the passengers were going to work, had no appropriate identification, and spoke little English. Accordingly, the court ruled, it was reasonable for the trooper to look into potential criminal activity on the part of the passengers. The opinion went on to state that these facts gave the officer not only “reasonable suspicion” to ask the passengers questions about their immigration status, but also “probable cause” to escort the group to ICE. These facts led the First Circuit to rule that the officer was entitled to “qualified immunity,” meaning that he was shielded from liability. In reaching this determination, the court stated that the trooper’s “conduct [did] not violate clearly established statutory or constitutional rights of which a reasonable person would have known.” (Opinion, February 4, 2010).
The ruling was well-received in the state of Rhode Island. An editorial in The Providence Journal stated that the First Circuit’s decision represents “a victory for common sense and the rule of law.” (The Providence Journal, February 12, 2010).

WHEN HOUSE Republicans last year sought to make the mere presence of illegal immigrants in the United States a felony punishable by one year in prison, the odious legislation sparked international condemnation. No country was more loudly indignant than Mexico. Then-President Vicente Fox called the legislation "shameful" and its targets "heroes" who make a crucial contribution to the U.S. economy.
Yet Mexico is hardly in a position to criticize. Since 1974, foreign immigrants in Mexico illegally have been subject to prison sentences of two years, plus a fine. Immigrants who are caught reentering Mexico after deportation face 10-year prison sentences, compared to two years here.
That is, until now. Mexican President Felipe Calderon has decided to tackle immigration reform of his own, and he is seeking the repeal of Article 123 of the General Population Law, which makes illegal immigrants the Mexican equivalent of felons.
The vast majority of the 185,000 illegal immigrants caught, detained and deported by Mexican officials each year come from Guatemala and Honduras, and many of them are in transit toward the Rio Grande. Human rights advocates have documented a lengthy list of abuses faced by these migrants — threats, extortion and even violence — stemming in part from their status as felons. In addition to amending Mexico's draconian and hypocritical law, Calderon's government is vowing to improve living conditions and medical services at the 48 detention centers where illegal immigrants are held pending deportation. Proposed upgrades include the addition of hot water and telephone service.
In a recent report, Mexico's National Commission on Human Rights accused immigration agents of numerous violations, citing one instance in which 78 migrants were crammed into four cells, each designed to hold only five people, and denied food and water for more than 24 hours.
These reforms would certainly improve the plight of detained migrants and also Mexico's relationship with its southern neighbors, as well as giving Mexico more moral standing to agitate against laws affecting its citizens in the United States. Those in this country who oppose guest-worker programs and a pathway to citizenship for illegal immigrants often cite Mexico's own harsher policies as the ones we should adopt, or at least complain about first.
Mexico can declaw that argument by closing the gap between its advocacy for Mexican nationals in the United States and how it treats illegal immigrants within its borders. Mexico is under pressure from the U.S. to block the flow of migrants heading north, and recent crackdowns, in part, have been to that end. Ensuring the human rights of its migrant population, however, is not only the right thing to do, it's good politics.

Specifically, he will argue for additional visas for Mexicans to enter the United States and Canada, the expansion of guest-worker schemes, and the "regularization" of illegal immigrants who reside throughout the continent. In a recent interview with CNN, the Mexican chief executive excoriated as "undemocratic" the extension of a wall on the US-Mexico border and called for the "orderly, safe, and legal" northbound flow of Mexicans, many of whom come from his home state of Guanajuato. Mexican legislators share Mr. Fox's goals. Silvia Hernández Enriquez, head of the Senate Committee on Foreign Relations for North America, recently emphasized that the solution to the "structural phenomenon" of unlawful migration lies not with "walls or militarization" but with "understanding, cooperation, and joint responsibility." Such rhetoric would be more convincing if Mexican officials were making a good faith effort to uplift the 50 percent of their 106 million people who live in poverty. To his credit, Fox's "Opportunities" initiative has improved slightly the plight of the poorest of the poor. Still, neither he nor Mexico's lawmakers have advanced measures that would spur sustained growth, improve the quality of the workforce, curb unemployment, and obviate the flight of Mexicans abroad. Indeed, Mexico's leaders have turned hypocrisy from an art form into an exact science as they shirk their obligations to fellow citizens, while decrying efforts by the US senators and representatives to crack down on illegal immigration at the border and the workplace. What are some examples of this failure of responsibility? • When oil revenues are excluded, Mexico raises the equivalent of only 9 percent of its gross domestic product in taxes - a figure roughly equivalent to that of Haiti and far below the level of major Latin American nations. Not only is Mexico's collection rate ridiculously low, its fiscal regime is riddled with loopholes and exemptions, giving rise to widespread evasion. Congress has rebuffed efforts to reform the system. Insufficient revenues mean that Mexico spends relatively little on two key elements of social mobility: Education commands just 5.3 percent of its GDP and healthcare only 6.10 percent, according to the World Bank's last comparative study. • A venal, "come-back-tomorrow" bureaucracy explains the 58 days it takes to open a business in Mexico compared with three days in Canada, five days in the US, nine days in Jamaica, and 27 days in Chile. Mexico's private sector estimates that 34 percent of the firms in the country made "extra official" payments to functionaries and legislators in 2004. These bribes totaled $11.2 billion and equaled 12 percent of GDP. • Transparency International, a nongovernmental organization, placed Mexico in a tie with Ghana, Panama, Peru, and Turkey for 65th among 158 countries surveyed for corruption. • Economic competition is constrained by the presence of inefficient, overstaffed state oil and electricity monopolies, as well as a small number of private corporations - closely linked to government big shots - that control telecommunications, television, food processing, transportation, construction, and cement. Politicians who talk about, much less propose, trust-busting measures are as rare as a snowfall in the Sonoran Desert. Geography, self-interests, and humanitarian concerns require North America's neighbors to cooperate on myriad issues, not the least of which is immigration. However, Mexico's power brokers have failed to make the difficult decisions necessary to use their nation's bountiful wealth to benefit the masses. Washington and Ottawa have every right to insist that Mexico's pampered elite act responsibly, rather than expecting US and Canadian taxpayers to shoulder burdens Mexico should assume.

San Rafael/ the rest of the nation and Illegal has more problems than the freaking Home Depot you need to take a ride out through the canal streets and surrounding neighborhood and take a look at what the third world looks like it is literally turning Marin County into a crime infested dump. Both political parties are to blame for this mess Do the math 300 million American citizens 30 to 40 million people have invaded our country from the border south Unemployment at 10% illegal alien @ 10% 30 Million. 3% of Illegal do farm labor that means the rest have either assaulted the blue collar jobs or have turned to crime or have became a burden on our various social programs . They make up 10% of the population but 30% of our prison population. I was just working doing a job building a 8’ fence around an area in San Rafael canal district where they have had four attempted sexual assaults by a group of gang members. While working in the area gangs of about 25 to 30 Latino male were right behind an elementary school saleing drugs and intating a young woman into the gang by having her perform sexual acts on about 10 in the bushes not 10’ from a walking path and 25’ from a school playground. While on the walking path, the made rude remarks to any women that dared to walk by and would glare at anyone who dared to make eye contact. This is just a micro cosmism to the whole problem Schools are broken prison are broken economy broken drugs gangs children born into gang families the negative effect on our society. WE as a country can no longer be the Safety valve for Mexico and the poverty that they continue to give us. WE needs to demand that that our laws are followed and send them home. Mind you, I am not saying all Mexican people are bad there are many hard working and good families in our communities legal and not legal, but it is defiantly time for America to take care of Americans first. I believe that the best thing is to send half home right away and if you send 15 million at home at once demanding that the government change down there maybe Mexico will use the resources it has to be what is predicted to be enough to make it an economic super power and turn into the great trade partner we were promised in NAFTA.We need to wake up. We are going to lose our vote thanks to our government legitamizing people who do not belong here and are unwilling to fight for ther own country this attitude is making our country like the turd world.

People of the United States, please do not hate me. I come to your country to make a better life for me and my family. I do not want much. just a yob and a used purple 1980-something nissan truck. You will not even know I'm here.
I come from a decent family in Guadalajara. They taught me to obey the law, and always do the right thing. I always obey the law, except for when I crossed your border illegally. Oh, and I don't pay taxes either. I drive without insurance, but that's ok right, because most Americanos already have it anyway? I had to steal someone else's identity to forge my social security card, but that's not really stealing because they won't know anyways right? When work is slow I go to home depot or Star Nursery to pick up a few dollars digging holes, or doing whatever the homeowner wants. I generally do not steal because most days I can get enough money to feed my anchor babies, but there have been a couple of times that I did go back to the gringo's home's to pick up a few tools and their lawnmower. I was able to sell those items at the pawn chop for enough money to put little juan in a soccer league. This one home that i dug holes at had a very pretty girl living there. I keep telling myself not to think about her, but sometimes I think she would like me if I stopped by and showed her my latin charm... and maybe some more if you know what I mean. I'll wait until she is home alone to make my move.
Every weekend mi familia and I invade, I mean, go to the parks. Maria, my wife, is going to have another baby. That's good news for us! We will go to UMC because at UMC they have to treat everyone, including us. I mean, how much can it really cost the American taxpayers?

The good thing for them is that almost 30% of their fellow inmates are illegal immigrants like them, so when the trouble starts, someone has their backs. People always complain about how the American taxpayers are shelling out so much money to keep illegal immigrants in American prisons, but believe me amigos, you don't want these guys on the streets... I know them. I almost went with them too. One time 3 years ago a coyote gave me 200 dollars (not pesos) to carry 45 pounds of bud across the border. It was close for me, but it was a good thing i made it! The border patrol is getting tougher, but we still manage to make it across for now.

at the point where we are now, it is no big deal that spanish was spoken here before english. what the posters are saying is that they are:
1. tired of calling government agencies and state agencies and almost every business in america and being told to press 1 for english and 2 for spanish.

ON EDUCATING THE ILLEGALS: Ever wonder why Mexico doesn’t educate their own people?
Worse public schools. America’s public schools already suffer under severe budget constraints, causing large class sizes, textbook shortages, and leaky ceilings. Yet, US law requires that all illegals receive free public education K-12. The Federation for American Immigration Reform estimates that this costs $7.4 billion dollars each year.
The birthrate among illegals is more than double that of legal US residents. The Pew Hispanic Center calculates that within seven years, the children of immigrants, legal and illegal, will account for one in nine school-age children in the US. The Urban Institute estimates that already, 15% of all school children in California are illegals, many of whom speak little English. These students are usually mainstreamed in classes with native English speakers. This means that teachers must slow down instruction, denying native English speakers their right to an
appropriate-level education.
The challenge is even greater because not all those students’ native language is Spanish: For example, in my nearest major school district, San Francisco, it would not be unusual to find a class that had native speakers of Chinese, Russian, Tagalog, Spanish, and English. Imagine the challenge of trying to educate them all. If your child were in that class, would you be confident that he or she would receive a quality education?
Immigrant children pose less obvious challenges to the schools. Barbara Nemko, the Napa County Superintendent of Schools, points out examples: “Unless she speaks Spanish, we have a hard time justifying hiring an even an excellent teacher… So much of our staff development
time must now be allocated to dealing with the needs of ‘English Language Learners.’ Our immigrant kids also come to school with serious health problems that we must address. For example, dentists now visit our high-immigrant schools providing dental services at no
cost to the student.”
Immigrant advocacy groups such as the Mexican-American Legal Defense Fund (MALDEF) and La Raza have additionally burdened the public schools by demanding that schools provide special controversial programs such as bilingual education, in which students are taught in Spanish for much of the day. Bilingual education programs exist throughout California even
after longitudinal research has not demonstrated their effectiveness and after a voter-approved an on those programs.
MALDEF and La Raza also pushed through legislation that allows, in 19 states, illegal immigrants to not only attend any public university in those states, but to pay in-state tuition, while legal residents of neighboring states must pay the out-of-state rate which is three to eight times more. It’s quite an injustice, for example, that a legal resident can be denied admission to taxpayer-supported Berkeley and must attend community college so an illegal foreign national can attend Berkeley—at in-state rates! And often, because of reverse discrimination admission
policies, the illegal is admitted with B grades while the rejected legal resident may have Agrades.

ON EDUCATING THE ILLEGALS: Ever wonder why Mexico doesn’t educate their own people?
Worse public schools. America’s public schools already suffer under severe budget constraints, causing large class sizes, textbook shortages, and leaky ceilings. Yet, US law requires that all illegals receive free public education K-12. The Federation for American Immigration Reform estimates that this costs $7.4 billion dollars each year.
The birthrate among illegals is more than double that of legal US residents. The Pew Hispanic Center calculates that within seven years, the children of immigrants, legal and illegal, will account for one in nine school-age children in the US. The Urban Institute estimates that already, 15% of all school children in California are illegals, many of whom speak little English. These students are usually mainstreamed in classes with native English speakers. This means that teachers must slow down instruction, denying native English speakers their right to an
appropriate-level education.
The challenge is even greater because not all those students’ native language is Spanish: For example, in my nearest major school district, San Francisco, it would not be unusual to find a class that had native speakers of Chinese, Russian, Tagalog, Spanish, and English. Imagine the challenge of trying to educate them all. If your child were in that class, would you be confident that he or she would receive a quality education?
Immigrant children pose less obvious challenges to the schools. Barbara Nemko, the Napa County Superintendent of Schools, points out examples: “Unless she speaks Spanish, we have a hard time justifying hiring an even an excellent teacher… So much of our staff development
time must now be allocated to dealing with the needs of ‘English Language Learners.’ Our immigrant kids also come to school with serious health problems that we must address. For example, dentists now visit our high-immigrant schools providing dental services at no
cost to the student.”
Immigrant advocacy groups such as the Mexican-American Legal Defense Fund (MALDEF) and La Raza have additionally burdened the public schools by demanding that schools provide special controversial programs such as bilingual education, in which students are taught in Spanish for much of the day. Bilingual education programs exist throughout California even
after longitudinal research has not demonstrated their effectiveness and after a voter-approved an on those programs.
MALDEF and La Raza also pushed through legislation that allows, in 19 states, illegal immigrants to not only attend any public university in those states, but to pay in-state tuition, while legal residents of neighboring states must pay the out-of-state rate which is three to eight times more. It’s quite an injustice, for example, that a legal resident can be denied admission to taxpayer-supported Berkeley and must attend community college so an illegal foreign national can attend Berkeley—at in-state rates! And often, because of reverse discrimination admission
policies, the illegal is admitted with B grades while the rejected legal resident may have Agrades.

Senators and Congressional aides braced Monday for the first test of Senator Majority Leader Harry Reid’s jobs bill—a cloture vote. This vote, set for Monday evening, will determine whether the Senate can proceed with debate on the jobs bill, also called the “Hiring Incentives to Restore Employment Act” or HIRE Act. At this time, reports from Capitol Hill are mixed as to whether there will be enough votes (60 are required) to pass a cloture vote.
Senator Reid introduced the HIRE Act last week hoping to focus on the issue of jobs and the economy, but disappointed immigration reformers by leaving out any mandate that jobs created by the bill go to U.S. workers. The bill has two major tax provisions, an exemption from payroll taxes for employers who hire new employees in 2010 and a $1,000 tax credit for employers who keep those employees for at least 52 weeks. Unfortunately, the bill does not require that these new workers be legal or that employers use E-Verify to confirm their work authorization. Moreover, Congressional staffers have confirmed that Senator Reid has already invoked a procedural maneuver that blocks any and all amendments to the bill.

Rep. Kenny Marchant (R-Texas) has offered the Mortgage E-Verify Act that would require a mortgagor to be verified through E-Verify when applying for a modification of a home loan owned by Fannie Mae or Freddie Mac.
"As a member of the House Financial Services Committee, I am happy to introduce my bill, the Mortgage E-Verify Act, which would require, as a condition for modification of a home mortgage loan held by Fannie Mae or Freddie Mac or insured by the Federal Housing Administration (FHA), that the mortgagor be verified under the E-Verify program," Rep. Marchant said in a press release. "My bill will potentially save millions by cutting down on fraudulent claims from illegal immigrants and protect taxpayers from subsidizing the restructuring or renegotiation mortgages of illegal immigrants."
Rep. Marchant's bill is a result of a major case in Nevada where a loan officer submitted false income and employment documentation to help illegal aliens secure FHA loans. The scam totaled $6.2 million in loans with many going into default, costing HUD nearly $2 million. The loan officer was found guilty on 32 counts of submitting false information.
"E-Verify is a fantastic program which I have supported making permanent for employers," Rep. Marchant said. "Mandating its use as a condition for home mortgage loan modifications would help eliminate waste, fraud, and abuse in the system and bring integrity to the process. In fact, the Treasury Department's Financial Crimes Enforcement division (FinCEN) estimates that mortgage fraud increased 1,411 percent from 1997 to 2005. Furthermore, two-thirds of fraud reports in the last decade are due to falsified statements on loan documents. My bill would curb these abuses and protect the taxpayers."

Come on people it is 1776 all over again. Some of the owners of the Federal Reserve live in England and Germany. The largest shareholder in the illegal stock of the Federal Reserve lives in England, by the way, this is why England's money is worth the most on earth. Gold prices are set in London each morning. The Euro is the second strongest currency followed by the USA.....we are mere puppets for paying the piper to make these people rich beyond imagination.
So, once again, U. S. citizens will pay for the lawlessness of our leaders and their friends on Wall Street. It is a very bad time for our country!
